ORDINANCE NO. 1052 <br />AN ORDINANCE PROVIDING FOR THE RECAPTURE OF FUNDS <br />EXPENDED BY THE VILLAGE OF ELK GROVE VILLAGE FOR <br />EXTENSION OF WATER UTILITIES SUPPERCEDING ORDINANCE 878 <br />WHEREAS, the Village of Elk Grove Village has heretofore determined that <br />the best interest of the Village required that its water utilities be extended <br />so as to provide for future connection thereto; and <br />WHEREAS, the President and Board of Trustees of the Village hereby determine <br />that the cost of said extensions should be recaptured when and if certain properties, <br />generally described hereafter, which would benefit by said extensions subsequently <br />annexed to the Village; <br />NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the <br />Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, as follows: <br />Section 1: That should any of the property located within an area bounded on <br />the west by the VFW property (Lot 18 Lumpp's Subdivision), on the east by the <br />existing Village limit (which is approximately 560 feet west of Tonne Road at that <br />point) on the south by Devon Avenue and on the north by a line approximately 408 <br />feet north of Devon Avenue, subsequently annex to the Village of Elk Grove Village <br />the owners of said property shall pay to the Village the sum of One Thousand Ten <br />Dollars ($1,010.00) for each acre, or a pro -rata amount for a portion of an acre, <br />as repayment for the Village's extension of said utilities system. <br />Section 2: That should any of the property located within the area bounded <br />on the west by Salt Creek, on the east by the VFW property (Lot 18 Lumpp's <br />Subdivision), on the south by Devon Avenue and on the north by a line approximately <br />408 feet north of Devon Avenue, subsequently annex to the Village of Elk Grove <br />Village the owners of said property shall pay to the Village the sum of Six <br />Hundred Five Dollars ($605.00) for each acre, or a pro -rata amount for a portion <br />of an acre, as repayment for the Village's extension of said utilities system. <br />Section 3: That the payment provision provided above shall be made on or <br />before the adoption of any ordinances annexing all or any portion of the property <br />generally described above. <br />Section 4: That the requirements contained herein shall be in addition to <br />any and all other conditions of annexation required by applicable statutes, laws <br />and ordinances and provisions of any Annexation Agreement hereinafter adopted. <br />Section 5: That this ordinance shall be in full force and effect from and <br />after its passage and approval according to law. <br />PASSED this <br />13th of <br />April <br />1976. <br />APPROVED this <br />13th of <br />April <br />1976. <br />VOTE: AYES <br />6 NAYS 0 <br />ABSENT <br />0 <br />r <br />ViIlage/Pres'dent <br />ATTEST: <br />1 <br />Village Cb.lrlk <br />
