ORDINANCE NO.- 427 <br />AN ORDINANCE AMENDING SECTION 11.306 OF THE MUNICIPAL CODE <br />RELATING TO DEPOSITS FOR STREET EXCAVATIONS <br />NOW, THEREFORE, BE IT ORDAINED by the President and Board of <br />Trustees of the Village of Elk Grove Village, Counties of Cook <br />and DuPage, Illinois: <br />Section,l. That Section 11.306 of the Municipal Code of Elk <br />Grove Village be and is hereby amended to read as follows: <br />"11.306 Deposit.) No such permit except as provided herein <br />shall be issued unless and until the applicant therefor has <br />deposited with the Clerk a cash deposit in the sum of $200.00, <br />if no pavement is involved, and $500.00 if the excavation is <br />in a paved area, to insure the proper restoration of the <br />ground and laying of the pavement, if any. In the event any <br />contractor shall have several jobs in process and shall have <br />cash deposits of $1,000 he shall not be required to make <br />additional deposits for any additional jobs and a special <br />escrow arrangement shall be made making available all deposits <br />for all jobs in process. From this deposit shall be deducted <br />the expense to the Village of relaying the surface of the <br />ground or pavement and of making the refill if this is done <br />by the Village or at its expense, and the balance shall be <br />returned to the applicant without interest after the tunnel <br />or excavation is completely refilled and the surface or <br />pavement is restored. Companies acting as the Village's <br />agent and public utilities franchised by the Village shall <br />not be required. to make the cash deposits called for herein." <br />Section 2. That this ordinance shall be in full force and <br />effect from and after its passage and approval according to <br />law. <br />PASSED this 9th day of Apra 1968. <br />APPROVED this 9th day of April , 1968. <br />Jack D.
