ORDINANCE NO. 265 <br />AN ORDINANCE AMENDING THE VILLAGE OF ELK GROVE VILLAGE ZONING ORDINANCE <br />RELATING TO PROPERTY BOUNDED BY DEVON AVENUE ON THE NORTH AND ROUTE 83 <br />ON THE WEST, IiN DU PAGE COUNTY, ILLINOIS <br />WHEREAS, the Board of Appeals of the Village of Elk Grove Village, sitting <br />as a Zoning Commission at a public meeting duly called and held according <br />to law (Appeal No. 62-7), considered the question of reclassifying the <br />real estate hereinafter described from R-1 (20,000 Square Feet Single <br />Family Dwelling District) to M-2 (Heavy Industrial District); <br />AND, WHEREAS, the President and Board of Trustees of the Village of Elk <br />Grove Village, having considered the recommendation of said Zoning Board <br />of Appeals, find and believe that the highest and best use of said real <br />estate is that of M-2 (Heavy Industrial District). <br />NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of <br />the Village of Elk Grove Village, Cook County, and DuPage County, Illinois: <br />Section 1. That an ordinance entitled "An ordinance to regulate and <br />limit the height and bulk of buildings; to regulate and limit the intensity <br />of the use of lot areas, and to regulate and determine the areas of open <br />space within and surrounding such buildings; to classify, regulate and <br />restrict the location of trades and industries and the location of <br />buildings designed for specified industrial business, residential and <br />other uses; to divide the entire Village of Elk Grove Village into <br />districts for the purpose of this ordinance; to fix standards to which <br />buildings or structures shall conform; to prohibit uses, buildings or <br />structures incompatible with the character of such districts respectively; <br />and to prevent additions to and alterations or remodeling of existing <br />buildings or structures in such a way as to avoid the restrictions and <br />limitations lawfully imposed hereunder, and to provide penalties for <br />violation hereof," passed and approved July 8, 1957, known as Ordinance <br />No. 20, as amended, be amended by reclassifying the following described <br />real estate from R-1 (20,000 Square Feet Single Family Dwelling District) <br />to M-2 (Heavy Industrial District): <br />The West half of Fractional Northwest quarter of Section 2, Township 40 <br />North, Range 11 East of the Third Principal Meridian, DuPage County, Illinois; <br />ALSO <br />The North half of the Northwest quarter of the Southwest quarter of Section 2, <br />Township 40 North, Range 11 East of the Third Principal Meridian, DuPage <br />County, Illinois; <br />ALSO <br />A part of the East half of fractional West half of Section 2, Township 40 <br />North, Range 11 East of the Third Principal Meridian, described as <br />follows: Commencing at the Northwest corner of said East half of said <br />fractional West half; thence South along the West line of said East half <br />of said fractional West half 38 chains and 162 links, more or less, to the <br />South line of the North half of said. Section; thence East 5 links along <br />said South line of North half of said Section; thence North 38 chains, <br />16z links, more or less, to the Northwest corner of the Subdivision known <br />as Devon Five Acre Farms; according to the plat thereof recorded June 10, <br />1947 as Document No. 522698; thence West 15 links, more or less, to the <br />place of beginning (excepting therefrom such part or portion thereof as has <br />heretofore been dedicated to the State of Illinois for Highway purposes by <br />instrument dated July 12, 1937 and recorded July 14, 1937 as Document <br />No. 381700), DuPage County, Illinois. <br />Section 2. That said real estate as reclassified shall be subject to all <br />the limitations and conditions placed upon properties in the M-2 (Heavy <br />Industrial District) as defined in the ordinances aforementioned. <br />-1- Ord. #265 <br />
