ORDINANCE NO. 3 <br />AN ORDINANCE AMENDING SECTIONS 11.302, 11.303 and 11.306 <br />OF THE MUNICIPAL CODE OF ELK GROVE VILLAGE, RELATING TO <br />APPLICATION AND ISSUANCE OF EXCAVATION PERMITS AND <br />PROVIDING FOR CASH ESCROWS TO GUARANTEE RESTORATION <br />NOW, THEREFORE, BE IT ORDAINED by the President and <br />Board of Trustees of the Village of Elk Grove Village, Counties <br />of Cook and DuPage, Illinois: <br />Section 1. That Section 11,302 of the Municipal Code <br />of Elk Grove Village be and is hereby amended to read as follows: <br />"11.302 Applications. Applications for such permits <br />shall be made to the Village Clerk, and shall describe the lo- <br />cation of the intended excavation or tunnel, the size thereof, <br />the purpose therefor, and the person, firm or corporation doing <br />the actual excavating work and the name of the person, firm or <br />corporation for whom or which the work is being done, and shall <br />contain an agreement that the applicant will comply with all or- <br />dinances relating to the work to be done." <br />Section 2. That Section 11.303 of the Municipal Code <br />of Elk Grove Village be and is hereby amended to read as follows: <br />"11.303 Issuance. No such permit shall be issued ex- <br />cept on order of Building Inspector." <br />Section 3. That Section 11.306 of the Municipal Code <br />f Elk Grove Village be and is hereby amended to read as follows: <br />"11.306 Deposit. No such permit shall be issued un- <br />less and until the applicant therefor has deposited with the <br />Clerk a cash deposit in the sum of One hundred ($100) Dollars, if <br />no pavement is involved, and Two hundred ($200) Dollars, if the <br />excavation is in a paved area, to insure the proper restoration <br />of the ground and laying of the pavement, if any. From this de- <br />posit shall be deducted the expense to the Village of relaying <br />the surface of the ground or pavement and of making the refill <br />if this is done by the Village or at its expense, and the balance <br />shall be returned to the applicant *.without interest after the <br />tunnel or excavation is completely refilled and the surface or <br />pavement is restored." <br />Section 4. That this ordinance shall be in full force <br />and effect from and after its passage, approval and publication, <br />according to law. <br />PASSED this 14th day of May, 1962. <br />APPROVED this 17th day of May, 1962. <br />s/ James R.
