I <br />ORDINANCE NO. 164 <br />AN ORDINANCE REZONING CERTAIN PROPERTY LOCATED ON THE <br />NORTHWEST CCRNER OF DEVON AVENUE AND TON14E ROAD IN THE <br />VILLAGE CF ELK GROVE VILLAGE, COOK COUNTY, ILLINOIS <br />WHEREAS, the Zoning Board of Appeals of the Village of Elk Grove <br />Village, Cook County, Illinois, sitting as a commission at a public <br />meeting duly called and held according to law, considered the question <br />of reclassifying from R-1 20,000 Square Foot Single Family Dwelling <br />District (so classified upon annexation) to B-1 Business District, the <br />real estate hereinafter described; and <br />WHEREAS, the Chicago Title and Trust Company as trustee under <br />Trust Agreement dated April 25, 1960 and known as Trust No. 42169, and <br />John Bolger, having assured the President and Board of Trustees of the <br />Village of Elk Grove Village of its and his fixed intention to develop <br />the whole of the property hereinafter described with a shopping center <br />in accordance with the provisions of a decree of the Circuit Court of <br />Cook County in a case designated as Chicago Title and Trust Company as <br />trustee under Trust Agreement dated April 25, 1960 and known as Trust <br />No. 42169, plaintiff, -vs- Village of Elk Grove Village, a municipal <br />corporation, defendant, No. 60 C 11807; and <br />WHEREAS, the President and Board cf Trustees of the Village of <br />Elk Grove Village has considered the recommendations of the Zoning Board <br />of Appeals, the decree of the Circuit Court of Cook County noted above, <br />and the agreement and promises of the Chicago Title and Trust Company as <br />trustee under Trust No. 42169 and John Bolger to develop the whole of <br />the hereinafter described property as a shopping center, with deliberate <br />speed; and <br />WHEREAS, the for reasons stated above the President and Board <br />of Trustees of the Village of Elk Grove Village consider the highest and <br />best use for said real estate is that of B-1 Business District use; <br />NOW, THEREFORE, BE IT ORDAINED by the President and Board of <br />Trustees of the Village of Elk Grove Village, Cook County, Illinois: <br />Section 1 That an ordinance entitled "An Ordinance to regulate <br />and limit the hcight and bulk of buildir4s; to regulate and limit the <br />intensity of the use of lot areas, and to regulate and determine the <br />areas of open spaces within and surrounding such buildings; to classify*, <br />regulate and restrict the location of trades and industries and the <br />location of buildings designed for specified industrial, business, <br />residential and other uses; to divide the entire Village of Elk Grove <br />Village into districts for the purpose of this ordinance; to fix stan- <br />dards to which buildings or structures shall conform; to prohibit uses, <br />buildings or structures incompatible with the character of such districts <br />respectively; and to prevent additions to and alterations or remodeling <br />of existing buildings or structures in such a way as to avoid the re- <br />strictions and limitations lawfully imposed hereunder, and to provide <br />penalties for violation hereof," passed and approved July 8, 1957, known <br />as Ordinance No. 2n, as amended, be amended by reclassifying from $-1 <br />20,000 Square Foot Single Family Dwelling District to B-1 Business <br />District, the following described real estate: <br />Lot 28 in William Lumpp's Devon Avenue Farms, being a Subdivision <br />in the South half of Section 33, Township 41 North, Range 11 <br />East of the Third Principal Meridian, Cook County, Illinois; ALSO <br />That part of the Southeast quarter of Section 33, Township 41 North, <br />Range 11 East of the Third Principal Meridian, described by begin- <br />ning at the point of intersection of the South line of said South- <br />east quarter with the center line of Tann Road; and running thence <br />North 120301 East along the center line of said Tome Road, 454.0 <br />feet for a place of beginning; thence North 780221 West, 434.8 feet; <br />thence North 3023' East, 151.47 feet; thence South 87008f East, <br />465.37 feet to the center line of said Tonne Road; thence <br />-1- <br />Unn <br />
