Section 6.016 APPEALS. Whenever the Chief of the Fire Department shall disapprove <br />an application or refuse to grant a license or permit applied for, or when it <br />is claimed that the provisions of the Code do not apply or that the true intent <br />and meaning of the Code have been misconstrued or wrongly interpreted, the <br />applicant may appeal from the decision of the Chief of the Fire Department to <br />the President and Board of Trustees within 30 days from the date of the decision <br />of the appeal. Thereupon the said President and Trustees shall designate a time <br />and place for a public hearing thereon and the applicant and Fire Chief may <br />present pertinent information. The decision of the President and Trustees shall <br />be final. <br />Section 6.017 PERMITS. It shall be unlawful to construct, install or enlarge <br />any tank, pump or piping equipment for the storage or handling of flammable or <br />volatile liquid such as defined in this article without having first obtained a <br />permit therefor. Application for such permits shall be made to the Village <br />Clerk, and shall be accompanied by a drawing to scale showing the location as <br />well as plans showing the type and nature of installation or alteration. <br />Section 6.018 APPROVAL. No such permit shall be issued until the Building <br />Inspector has certified that the contemplated work fully complies with the <br />ordinances of the Village. <br />For installation of fuel oil tanks having a capacity of more than two <br />thousand gallons and less than 20,000 gallons - $75.00. <br />For installation of tanks for storage of gasoline having a capacity of <br />less than 10,000 gallons - $75.00. <br />For installation of fuel oil tanks having a capacity of 20,000 gallons <br />or more - $75.00. <br />For installation of gasoline storage tanks having a capacity of 1,000 or <br />over - $75.00. <br />For installation of tanks for other flammable liquids - $75.00.. <br />Section 6.019 LICENSES. It shall be unlawful for any person, firm or corporation <br />to sell or deal in flammable liquids, gasses and solids including the sale of <br />paints but excluding automobile service stations without having first obtained <br />a license therefor. The annual fee for said license shall be 630.OQ. <br />Section 6.020. PENALTIES. <br />A. Any person who shall violate any of the provisions of the Code hereby <br />adopted or fail to comply therewith, or who shall violate or fail to comply <br />with any order made thereunder, or who shall build in violation of any detailed <br />statement of specifications or plans submitted and approved thereunder, or <br />any certificate or permit issued thereunder and from which no appeal has been <br />taken, or who shall fail to comply with such an order as affirmed or modified <br />by the Chief of the Fire Prevention Bureau or by a court of competent jurisdiction, <br />within the time fixed herein, shall severally for each and every such violation <br />and noncompliance respectively, be guilty of a misdemeanor, punishable by a fine <br />of not less than $10.00 nor more than $200.00 or by imprisonment for not less <br />than 10 days nor more than six months, or by both such fine and imprisonment. <br />The imposition of one penalty for any and all such persons shall be required to <br />correct or remedy such violations or defects within a reasonable time; and when <br />not otherwise specified, each ten days that prohibited conditions are maintained <br />shall constitute a separate offense. <br />B. The application of the above penality shall not be held to prevent the <br />enforced removal of prohibited conditions. <br />Section 3. That all ordinances of this Village in conflict herewith are herety <br />repealed. <br />Section 4. This ordinance shall be in full force and effect upon its passage, <br />approval and publication according to law. <br />Passed and Approved this 26th day of June, 1961. <br />ss James R.
