ORDINANCE NO. 132 <br />AN ORDINANCE PERTAINING TO THE CONSTRUCTION OF PUBLIC <br />IMPROVESIENTS BY PRIVATE CONTRACT AND AMENDING SECTION 4 <br />OF ORDINANCE NO. 118 <br />BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE <br />VILLAGE OF ELK GROVE VILLAGE, COOK COUNTY, ILLINOIS: <br />SECTION 1 That Section 4 of Ordinance No. 118, said ordinance <br />entitled "An Ordinance Pertaining to Construction of Public Improvements <br />by Private Contract," be and the same is hereby amended to read as follows: <br />SECTION 4 Any person, firm or corporation obtaining a permit <br />shall also give bond conditioned that he or they will suitably guard <br />and protect any excavation or obstruction and defend, save, keep <br />harmless and indemnify the Village of Elk Grove Village of and from <br />any and all action, snits, costs, damaged and expenses whatsoever, <br />including attorney's fees which shall or may at arty time happen to <br />come to it for or on account of any injuries or damages received or <br />sustained by any part or parties by or from acts or omissions of the <br />applicant or his or their services in doing such work; and that he or <br />they will restore such streets, sidewalks or public property to its <br />former condition and to complete such work as quickly as possible and <br />when completed to notify the Village Engineers of such fact; and <br />guaranteeing that such work so made in the public streets, sidewalks <br />and public properties and in properties to be dedicated for such public <br />use, is made and constructed in a good and workmanlike manner and of <br />good and proper material and that the same shall not deteriorate, cave <br />in or require repair or reconstruction for a period of at least one (1) <br />year from the time of the approval of such work as herein mentioned. <br />SECTION 2 That this ordinance shall be in full force and <br />effect upon passage, approval and publication according to law. <br />PASSED this 25th dayQf April, 1960 <br />APPROVED this day of , 1960 <br />ATTEST: <br />Charles A.
