RESOLUTION NO. 18-89 <br />A RESOLUTION DIRECTED TO THE COOK COUNTY BOARD OF COMMISSIONERS, <br />COOK COUNTY BOARD OF APPEALS, AND THE COUNTY CLERK FOR TRANSMITTAL <br />TO COOK COUNTY BOARD OF COMMISSIONERS IN RESPONSE TO THE PUBLIC <br />HEARING HELD BY THE COOK COUNTY BOARD OF APPEALS ON MARCH 3, 1989 <br />REGARDING THE REZONING OF PROPERTY LOCATED ON THE NORTH SIDE OF <br />DEVON AVENUE APPROXIMATELY 454 FEET WEST OF RIDGE AVENUE <br />WHEREAS, the petitioner and owner, Michael Seay, of the property <br />legally described as follows: <br />Lot 9 and 10 (except N. 210 ft. thereof), in Wm. Lumpp's <br />Devon Avenue Farms Subdivision of part of South 1/2 of <br />Section 33, Township 41 North, Range 11, East of the <br />Third Principal Meridian in Cook County, Illinois <br />has petitioned for a map amendment to rezone from R-4 Single Family <br />Residential District to C-3 General Service District for office and retail <br />service business, <br />WHEREAS, said case has been docketed as Docket Number 5150 by the Cook <br />County Zoning Board of Appeals: and <br />WHEREAS, the Village of Elk Grove Village is contiguous to this <br />property on the North side. <br />NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees <br />of the Village of Elk Grove Village, Counties of Cook and DuPage, State of <br />Illinois as follows: <br />Section 1: That the Village of Elk Grove Village does hereby submit <br />the following response and recommendation regarding the petitioner's <br />request for rezoning of the subject property described above: <br />a. The petitioner stated that he intends to connect to Elk Grove <br />Village water and provide a septic system until sanitary <br />sewer is extended to lots 9 and 10. However, the parcels of <br />property are outside the corporate limits of Elk Grove Village <br />and, therefore, will not receive sanitary sewer or water <br />service from the Vi age of Elk Grove. <br />b. The State of Illinois regulatory flood plain maps reflect <br />approximately fifty percent of Lots 9 and 10 to be located <br />within the flood plain. <br />c. The County of Cook should require a hydrologic study using <br />Illinois Department of Transportation hydrologic model in <br />order to determine the quantity of water that will be dis- <br />placed by the development as well as the necessary <br />compensatory storage. <br />d. The Illinois Department of Transportation, in a report <br />dated March 10, 1989 and attached as Exhibit "A" states <br />that care should be exercised for developments on Devon <br />Avenue (including Lots 9 and 10 in Wm. Lumpp's Devon <br />Avenue Farms Subdivision) to ensure that development in <br />the area does not increase flood potential in Elk Grove <br />Village. <br />
