RESOLUTION NO. 70-86 <br /> A RESOLUTION STATING THE POSITION OF THE VILLAGE OF ELK GROVE <br /> VILLAGE RELATIVE TO PENDING NEGOTIATIONS FOR A FRANCHISE AGREEMENT <br /> WITH ILLINOIS BELL TELEPHONE COMPANY <br /> WHEREAS, the Northwest Municipal Conference (NWMC) is a corporate <br /> organization representative of municipalities and townships chartered <br /> within the State of Illinois and the County of Cock; and <br /> WHEREAS, the public officials of the NWMC represent thirty local <br /> government bodies and a population over 775,000 Illinois residents; <br /> and <br /> WHEREAS, in 1984, the Illinois Bell Telephone Company entered into <br /> three(3) year iterim franchise agreements expiring January 1, 1987, <br /> with the member municipalities of the NWMC, and <br /> WHEREAS, it is in the mutual interests of both the Illinois Bell <br /> Telephone Company and municipalities to continue to enter into franchise <br /> agreements; and <br /> WHEREAS, it is economically beneficial for the Illinois Bell Telephone <br /> Company to continue to explore new uses for phone lines, including: <br /> fiber optics, computers, video transmissions, cellular, interactive, <br /> and bypass networks, such that a general communications franchise needs <br /> to be developed; and <br /> WHEREAS, communication technology continues to evolve rapidly; <br /> NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees <br /> of the Village of Elk Grove Village, Cook and DUPage Counties, Illinois: <br /> Section 1. That the franchise agreement shall include the following: <br /> - The franchise compensation fee shall be based on a percentage <br /> of gross revenues collected by Illinois Bell Telephone Company <br /> for all phases of its communication business. <br /> - The franchise agreement should address the cost-free burial of <br /> overhead lines in a coordinated approach with other utilities. <br /> - The term of the franchise agreement renewal should be limited <br /> in order that changes in technology can be reviewed and incorporated <br /> as appropriate. <br />
