R830LUTION N0. 34-61 <br />UW'CWlj Flovn 1 l. 1 w <br />WHEREAS; Community Consolidated School District No. 59, Cook <br />County, Illinois) has requested that the Village of Elk Grove Village <br />dismiss an appeal from an order of Judge Roberts entered in the case <br />of Pioneer Trust -vs- County of Cook and Village of Elk Grove Village, <br />Circuit Court of Cook County case No. 60 C 12876, which appeal is <br />presently pending before the Appellate Court of the State of Illinois, <br />First District; and <br />WHEREAS, The Village of Elk Grove Village has been informed <br />by said Community Consolidated School District Nol 59, Cook County, <br />Illinois, that it has in fact entered into a voluntary agreement dated <br />May 1, 1961 between itself and Oscar Brotman and Leonard Sherman, geneeal <br />partners of Oasis Outdoor Ltd., which agreement is to the mutual satis- <br />faction of said parties; and <br />WHEREAS) The Village deems it to be to the best interest of <br />of the Village of Elk Grove Village and its residents that the afore- <br />mentioned appeal be dismissed in accordance with the petition of said <br />School District; <br />NOds THEREFORE, BE IT RESOLVED by the President and Board of <br />Trustees of the Village of Elk Grove Village, Cook County, Illinois: <br />Section 1. The Village of Elk Grove Village by its President <br />and Board of Trustees does hereby authorize the dismissal of a pending <br />appeal to the Appellate Court of Illinois, First District, in the case <br />of Pioneer Trust, etc., etal -vs- County of Cook and Village of Elk <br />Grove Village, designated by the Circuit Court of Cook County as case <br />No. 60 C 12876. <br />BE IT FURTHER RESOLVED by the President and Board of Trustees <br />of the Village of Elk Grove Village, Cook County, Illinois: <br />Section 2. That the Village President and/or the Village <br />Attorney be and are hereby instructed and authorized to enter into any <br />stipulations, agreements to waive appeal, or any other documents, or take <br />any other action which is necessary to discontinue the appeal in the <br />above entitled cause. <br />Section 3.
