LOCAL LIQUOR CONTROL COMMISSIONER <br />OF THE VILLAGE OF ELK GROVE VILLAGE, ILLINOIS <br />SPECIAL ORDER NO.2020-01 <br />WHEREAS, on March 19, 2020, as a result of Governor JB Pritzker's Executive Order 2020-07, <br />the Illinois Liquor Control Commission issued guidance on whether a license holder authorized to conduct <br />on -premises alcoholic liquor sales only (On -Premises Only Retailers), may sell alcoholic liquor for <br />consumption off of the licensed premises (Packaged Sales or To Go Sales), in order to relieve hardships to <br />on -premise retail alcoholic liquor licensees as a result of the COVID-19 pandemic, subject to approval of <br />the Local Liquor Control Commissioner; and <br />WHEREAS, the Illinois Liquor Control Act prohibits any person to have in his possession for sale <br />at retail any alcoholic liquor except in original packages (235 ILCS 5/6-22). The Commission has not <br />authorized the sale of premixed cocktails in non -original containers for off -premises consumption; and <br />WHEREAS, the Village of Elk Grove Village Local Liquor Control Commissioner is acutely <br />aware of the hardships imposed as a result of the COVID-19 pandemic; and <br />WHEREAS, consistent with the authorization granted by the Illinois Liquor Control Commission <br />and in furtherance of the authority granted the Local Liquor Control Commissioner of the Village of Elk <br />Grove Village, the following Special Order No. 2020-01 is hereby issued to all Elk Grove Village <br />restaurants that currently hold a Class A or Class D liquor license that offers carry -out food orders during <br />this COVID-19 pandemic effective immediately: <br />IT IS HEREBY ORDERED: <br />1. Said restaurant retail license, which includes an on -premise only license, shall be authorized to conduct <br />packaged sales, "To Go" sales, and curbside pickups intended to promote social distancing during the <br />liquor sale hours for the licensed premises. <br />2. Temporary liquor delivery for all Class A and Class D liquor license holders is prohibited in the Village <br />of Elk Grove Village. <br />3. All restaurants with a Class A or Class D liquor license shall only permit the sale of alcoholic beverages <br />pertaining to their registered license along with the purchase of food orders available for pickup or <br />curbside. <br />4. All alcoholic sales including beer, wine, pre -mix margaritas, sangrias, etc. shall be sold in the original <br />sealed container pursuant to 235 ILCS 5/6-22. <br />5. All orders must be picked up inside the restaurant or be available for curbside pickup for a restaurant <br />representative over twenty-one years of age to request the examination of the recipient's state -issued <br />identification to ensure the recipient is over the age of twenty-one years. If such observation of the <br />recipient or recipient identification cannot be accomplished while respective safe social distancing, the <br />alcoholic liquor shall be returned with a full refund. <br />6. Alcoholic liquor conditions set forth in this Special Order No. 2020-01 herein are temporary and no <br />additional fees or licenses are required. This Special Order 2020-01 shall be rescinded upon the <br />termination of the COVID-19 emergency restrictions imposed by Governor JB Pritzker. <br />Ordered th' t, day of April, 2020. <br />Mayor C B.
