KNICKERBOCKER Village Attorney Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting of the Village President and Board of Trustees on August 14, 2018, this Executive Session was called to consider review of Personnel. Number of pages attached: 1 Date(s) of review for release: March 2018 Date of approval for release: Date approved by Village Board: September 11, 2018 August 14, 2018 6:30 p.m. The Supreme Court has ruled that unions cannot require non-members to pay fair -share dues as it violates their first amendment rights. This is an issue because it relates to the Village's actions in taking money out of employee paychecks to give to unions. The Supreme Court requires affirmative consent to rightfully collect dues. The Illinois Attorney General issued an opinion that union contracts do not need to be re -bargained and fair share provisions can still apply, but it does not speak to the requirement to ensure affirmative consent for the Village to collect dues. The Village will issue a letter to all union members including the opinion of the Attorney General and saying that any employee can inform the Village they want to opt out of union payments at any time and the Village will honor that request. The meeting was adjourned at 6:34 p.m.
