Zoning Variation — Docket #20-3 — 632 DuPont Court
The meeting was held via GoToMeeting teleconference
Chairman Childress called the meeting to order at 7:00 pm and read a statement describing the hearing
notification procedure as well as the legal notice.
The petitioner, Sebastian Falinski, (Owner of Record), was sworn in and asked to present his case.
The petitioner explained the hardship is that the rear yard is shallow due to the double frontage of a
corner lot property, leaving a small rear yard.
Chairman Childress opened the meeting to questions from the board.
Member Bookler asked if the fence was proposed to line up with the fence at 1958 Baltimore Drive.
The petitioner agreed that matching the setback at 1958 Baltimore Drive was the intent of this fence's
installation.
Chairman Childress read the petitioner's letter regarding the other similarly situated corner properties
that received fence variances in this subdivision including 1958 Baltimore Drive and 624 DuPont Court.
A discussion was had between ZBA members on the depth of the fence from the lot line as it exists at
1958 Baltimore Drive, and if that same distance would be maintained with the petitioner's proposal.
Staff member Kozor verified that the fence at 1958 Baltimore Drive was approximately ten (10') feet
from the east lot line and that this proposed variance places the petitioner's fence at approximately the
same setback as the property follows the curve of the sidewalk and street.
No objections were made by ZBA members.
No additional comments were received from the public.
Chairman Childress called for the motion.
A motion to DO GRANT the variation to permit the installation of a four (4') foot high open type fence
which will extend approximately nineteen (19') feet beyond the nearest front corner of the principal
structure on the adjacent single-family residential lot to the west at 630 DuPont Court and which will
extend approximately twenty-three (23') feet beyond the nearest front corner of the principal structure
on the adjacent single-family residential lot to the south at 640 Delaware lane was made by Member
Colgan which was seconded by Member Dohrer.
Upon voting (AYES — Bookler, Childress, Colgan, Dohrer, Jameel, and Spragg.) (NAYES- None.) (ABSENT
— Romanski, Serrano, Kelley.)
The motion carried.
Mr. Childress advised the petitioner to contact the Village Clerk and be available for the subsequent
Village Board Meeting that will hear the request. The meeting adjourned at 7:33 p.m.
