Zoning Variation — Docket #20-6 — 501 Stonehaven Avenue
Chairman Childress called the meeting to order at 7:00 pm and read a statement describing the hearing
notification procedure as well as the legal notice.
The petitioners, Herbert and Cindy Medlock, (Owners of Record), were sworn in and asked to state their
case for requesting the zoning variation.
The petitioners explained their hardship was that they wanted to replace the fence that has been in the
same location for the past 44 years. The petitioners stated that without the fence installed in the
proposed location, they would be left with a much smaller backyard.
Chairman Childress opened the meeting to questions from the board.
Member Serrano stated that he only had a concern with the large hedge that was adjacent to the fence
as it may be a traffic obstruction.
The petitioners stated that they plan to trim the hedge.
Member Spragg similarly had a concern with the hedge encroaching the sidewalk, and affirmed that this
zoning discussion was not about the landscaping. He had no issue with the proposed fence variation.
Member Bookler agreed that the hedge is very large and may cause a sight obstruction at the
intersection.
Member Latrofa asked if the fence was there the since the house was built. He also agreed that the
hedge is overgrown at the sidewalk and limits visibility at the intersection.
The petitioners affirmed that the fence had been in the current location since the house was built.
Chairman Childress read a letter into the public record from a resident who has family members who
live on Stonehaven Avenue. The resident had no objection with the fence variation, but did have a
concern with the obstruction that the hedge causes at the intersection. (ZBA 20-6 Exhibit 1).
Chairman Childress asked what the code was for landscaping.
Staff member Kozor responded that no landscaping is permitted within the designated driveway and
street intersection sight line triangle. Staff member Kozor stated that he visited the property prior to
the hearing and confirmed that the hedges were not in violation of the Zoning Ordinance.
The petitioners acknowledged that with so many comments on the existing landscaping, they would like
to be a good neighbor and trim back the hedge to not impede visibility and walkability.
Chairman Childress asked if there any questions from the audience. None were offered.
Chairman Childress called for the motion.
A Motion to DO GRANT a variation to permit the installation of a six (6') foot high vinyl privacy fence
which will extend approximately twenty-three (23') feet beyond the nearest front corner of the principal
structure on the adjacent single-family residential lot to the east at 267 Cosman Road. This fence is a
proposed replacement for the existing six (6') foot high privacy fence in the same location.
This Motion was made by Member Bookler which was seconded by Member Serrano.
Upon voting (AYES — Bookler, Childress, Latrofa, Serrano, Spragg) (NAYES- None.) (ABSENT — Colgan,
Kelley, Jameel, Romarski.)
The motion carried.
Mr. Childress advised the petitioners to contact the Village Clerk and be available for the subsequent
Village Board Meeting. The meeting adjourned at 7:18 p.m.
