Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting
of the Village President and Board of Trustees on April 9, 2019, this Executive Session was called
to consider review of Litigation.

There is a pending lawsuit settlement that is now heading to mediation. Several years ago a
former police officer rear ended a vehicle in front of the funeral home. Two individuals have
already settled for around $10,000 each. The third individual had a pre-existing condition and
may increase her demand to $500,000 to $1 million. The Village's self-insurance deductible is
$200,000 and Village also has insurance for up to $2 million. The Village will try to make the
case to the arbitrator regarding the passenger's pre-existing condition and that fact that she was
not wearing a seatbelt to mitigate the settlement. The mediation is set for April 25.
