AN ORDINANCE AMENDING ORDINANCE NO. 2867 BY APPROVING AN AMENDED SITE PLAN AND GRANTING A SPECIAL USE PERMIT FOR A DRIVE THROUGH FACILITY ON PROPERTY LOCATED AT THE NORTHEAST CORNER
OF HIGGINS ROAD AND KING STREET (DUNKIN DONUTS)
WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, pursuant to Ordinance No. 2867 adopted on December 3, 2001, approved a re-zoning and Special Use Permit
for a Dunkin Donut facility and a Togo Store with a drive through facility on property located at the northeast corner of Higgins Road and King Street; and
WHEREAS, marketing changes which have occurred subsequent to December 3, 2001 have necessitated a change in the site plan and the special use permit as previously granted; and
WHEREAS, Third Dunkin’ Donuts Realty, Inc. has requested an amended site plan and a revised Special Use Permit to permit an approximate 1,800 square foot Dunkin Donuts restaurant facility
with a drive through facility attached thereto; and
WHEREAS, the Plan Commission of the Village of Elk Grove Village at a Public Hearing duly called and held according to law considered the question of approving the revised site plan
and granting an amended Special Use Permit; and
WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after having reviewed the recommendation and finding of said Plan Commission, find and believe that it
is in the best interest of the Village to amend the site plan previously approved by Ordinance No. 2867 and to grant a Special Use Permit for the Dunkin Donuts drive through facility.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That Ordinance No. 2867 adopted on December 3, 2001 with respect to the Dunkin Donuts facility located at the northeast corner of Higgins Road and King Street be amended
by approving an amended site plan, copies of which are on file in the Office of the Village Clerk and by granting a Special Use Permit to permit a drive through facility subject to
the conditions and requirements as set forth in the findings and recommendation of the Plan Commission dated August 8, 2005, which findings and recommendation are incorporated into
this Ordinance.
Section 2: That this Ordinance shall be in full force and effect from and after its passage and approval according to law.
