AN ORDINANCE AMENDING CHAPTER 4 GARBAGE AND REFUSE OF TITLE 4 OF THE VILLAGE CODE ESTABLISHING SPECIFICATIONS FOR GARBAGE AND REFUSE CONTAINERS FOR CERTAIN SINGLE-FAMILY ATTACHED DWELLING
UNITS
WHEREAS, the Recycling and Waste Committee of the Village of Elk Grove Village has investigated certain problems that have existed with respect to the placement of garbage and refuse
containers and bags in certain single-family attached dwelling areas in the Village; and
WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after having considered the recommendation of the Recycling and Waste Committee, find and believe that
it is the best interest of the Village to amend the storage of garbage and refuse section of the Village Code.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That Section 4-4-1 A.2 pertaining to specifications of garbage and refuse containers be and the same is hereby amended by adding thereto a new paragraph which shall read
as follows:
When four (4) or more single-family attached dwelling units utilize a single location for the collection of garbage and refuse they shall be required to utilize a rigid container made
of metal or plastic, not to exceed thirty (30) gallons in capacity and sold commercially for the purpose of garbage and refuse disposal. The container shall have a close fitting top.
Plastic non-rigid containers shall not be allowed. Containers provided by the franchised waste hauler may also be used pursuant to the contract with the Village.
Section 2: That any person, firm or corporation violating any provisions of this
Ordinance shall be subject to a fine of not less than $50.00 nor more than $500.00 for each offense.
Section 3: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form.
Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
