HomeMy WebLinkAboutORDINANCE - 3035 - 4/26/2005 - ALL FEES PAID PRIOT TO TRANSFER STAMPORDINANCE NO. 3035 AN ORDINANCE AMENDING SECTION 3-1-4 AND SECTION 3-2-5G OF THE VILLAGE CODE BY REQUIRING ALL PARTIES APPLYING FOR A REAL ESTATE TRANSFER STAMP OR A BUSINESS LICENSE TO PAY ANY OUTSTANDING FINANCIAL OBLIGATION TO THE VILLAGE WHICH MAY BE DUE AT THE TIME OF THE ISSUANCE OF THE TRANSFER STAMP OR BUSINESS LICENSE WHEREAS, the Director of Finance and the Village Attorney have reviewed various financial records of the Village and determined that a substantial amount of individuals have unpaid parking tickets or other citations, or otherwise have outstanding unpaid obligations to the Village; and WHEREAS, the enforcement methods utilized by the Village have not in all instances provided for a high percentage of collection with respect to these outstanding financial obligations; and WHEREAS, it has been determined that requiring individuals who apply for a real estate transfer stamp or a business license to satisfy any and all outstanding financial obligations to the Village in order to receive the transfer stamp or business license will substantially reduce the amount of outstanding financial obligations owed to the Village. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Section 3-1-4 Investigation of Applicants; Granting of License of the Village Code be amended by adding a paragraph between the two existing paragraphs, which paragraph shall read as follows: In addition, in all cases, the Director of Finance or his/her designated agent shall review applicable Village Records to determine whether the license applicant requesting the license has any outstanding financial obligations to the Village. If any unpaid financial obligation exist, that amount, plus any interest or applicable penalties which may have accrued thereon, shall be added to the license fee herein imposed. Upon payment of the license fee, together with all added costs and fees, the license shall be issued to the individual requesting same. Should the license applicant dispute the existence of all or any part of the outstanding obligation and can provide evidence with respect thereto to the Director of Finance or his/her designated agent, then and in such case the Director of Finance with approval by the Village Manager, is authorized to settle and compromise the amount due, in whole or in part. The decision of the Director of Finance and the Village Manager shall be deemed final. Section 2: That that portion of Section 3-2-5G Collection of Tax; Revenue Stamps Required which presently reads: Upon payment of the tax herein levied and imposed, the revenue stamps so purchased shall be affixed to the deed or other instrument of conveyance. Be amended to read as follows: Prior to the issuance of the revenue stamps, the Director of Finance or his/her designated agent shall review applicable Village records to determine whether the seller or grantor requesting the revenue stamps has any outstanding financial obligation to the Village. If unpaid financial obligations exist, that amount, plus any interest or penalties which may have accrued thereon, shall be added to the transfer tax herein imposed. Upon payment of the tax herein, together with all added costs and fees, the revenue stamps so purchased shall be affixed to the deed or other instrument of conveyance. Should the seller or grantor dispute the existence of all or any part of the outstanding obligation and can provide evidence with respect thereto to the Director of Finance or his/her designated agent, then, and in such case, the Director of Finance with the approval of the Village Manager is authorized to settle and compromise the amount due, in whole or in part. The decision of the Director of Finance and the Village Manager shall be deemed final. Section 3: That Section 8-3A-9J Action on Application of Title 8, Engineering, Building and Community Development, be and the same is hereby amended to read as follows: J. Action on Application: The Director of Engineering and Community Development shall examine application for permits, within a reasonable time after filing. In addition, the Director of Engineering and Community Development shall contact the Director of Finance in order to determine whether the applicant requesting the permit has any outstanding financial obligations to the Village. If any unpaid financial obligations exist, that amount, plus any interest or applicable penalties which may have accrued thereon, shall be added to the building permit fee herein imposed. Should the building permit applicant dispute the existence of all or any part of the outstanding financial obligation and provide evidence with respect thereto to the Director of Finance or his/her designated agent, then and in such case, the Director of Finance, with approval by the Village Manager, is authorized to settle and compromise the amount due, in whole or in part. The decision of the Director of Finance and the Village Manager shall be deemed final. If, after examination, including financial obligation, he finds no objections to the application for the permit and it appears that the proposed work will be in compliance with the laws and ordinances applicable thereto, and the proposed construction or work will be safe, he shall approve such application and issue a permit for the proposed work as soon as practicable. If his examination reveals otherwise, he shall reject such application and notify the applicant. Section 4: That the Village Clerk is authorized to publish this Ordinance in pamphlet form. Section 5: That this Ordinance shall be in full force and effect from and after its passage, approval and publication to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 26th day of April 2005.
