ORDINANCE NO. 3045
AN ORDINANCE GRANTING A VARIATION OF SECTION 3-7:D.4 OF THE ZONING ORDINANCE TO PERMIT THE EXISTENCE OF A POOL AND ATTACHED DECK THAT ENCROACHES APPROXIMATELY 5’ 4” INTO THE REQUIRED
8’ SIDE SETBACK ON PROPERTY LOCATED AT 377 EAST ELK GROVE BOULEVARD (MARQUES)
WHEREAS, the Zoning Board of Appeals of the Village of Elk Grove Village, at a Public Hearing duly called and held according to law, considered the question of granting a variation
of Section 3-7:D.4 of the Zoning Ordinance to permit the existence of a pool and attached deck which encroaches into the required 8’ side yard setback on property located at 377 East
Elk Grove Boulevard, Elk Grove Village; and
WHEREAS, the Mayor and Board of Trustees, after having reviewed the finding of fact of the Zoning Board of Appeals and in further consideration of the recently adopted legislation concerning
building permit fees, find and believe that sufficient hardship exists to justify the granting of said variation.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That there be granted a variation of Section 3-7:D.4 of the Zoning Ordinance to permit the continued existence of a pool and attached deck that encroaches approximately
5’ 4” into the required 8’ side setback on property located at 377 East Elk Grove Boulevard, Elk Grove Village, Illinois, which property is identified by the following property identification
number:
08-33-204-008-0000
Section 2: That the Director of Engineering and Community Development is hereby directed to charge the appropriate building permit fee as required by Village Ordinance.
Section 3: That this Ordinance shall be in full force and effect from and after its passage and approval according to law.
VOTE: AYES: 5 NAYS: 0 ABSENT: 1
