AN ORDINANCE APPROVING THE DEVELOPMENT OF A STEAK'N SHAKE
RESTAURANT WITH A DRIVE THROUGH AND GRANTING A VARIATION
THEREBY REDUCING THE NUMBER OF STACKING SPACES FROM TWELVE
(12) TO EIGHT (8)
WHEREAS, the Plan Commission and the Zoning Board of Appeals at a joint
hearing, duly called and held according to law considered the question of approving
the development of a Steak'n Shake restaurant with an attached drive-thru as required
by the Annexation Agreement for the subject property and the granting of a variation
which would reduce the number of stacking spaces from twelve (12) to eight (8); and
WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove
Village, after having considered the recommendations of the Plan Commission and
the Zoning Board of Appeals, find and believe that it is in the best interest of the
Village to approve the development subject to the conditions hereinafter set forth and
grant the variation as recommended by the Zoning Board of Appeals.
NOW, THEREFORE BE IT ORDAINED by the Mayor and Board of Trustees of
the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That the Village hereby approves the development of the Steak'n
Shake restaurant located south of the intersection of Meacham and Biesterfield Roads
including the approval of the Plat of Re -subdivision and approval of the site plan
subject to the condition that the Plan Commission approve the Landscape Plan to be
submitted at some time in the future.
Section 2: That there be granted a variation of the Zoning Ordinance
pertaining to required stacking spaces to permit a reduction in the Village's stacking
requirements for cars at a drive-thru from twelve (12) to eight (8).
Section 3: That this Ordinance shall be in full force and effect from and after
its passage and approval according to law.
VOTE: AYES: 5 NAYS: 0 ABSENT: 1
