NO. 1195 AND 1672ORDINANCE NO. 2955 AN ORDINANCE AMENDING ORDINANCE NO. 1195 AND ORDINANCE NO. 1672 PERTAINING TO MULTI-FAMILYDWELLINGS AT THE REGENCY SQUARE APARTMENT COMPLEX TO PERMIT THE CONSTRUCTION OF THREE (3) CONDOMINIUM BUILDINGS WITH A TOTAL OF 104 UNITS (KCN) WHEREAS, the Village of Elk Grove Village, pursuant to Ordinance No. 1195, thereafter amended by Ordinance No. 1672, approved the construction of apartment buildings for property located north of Landmefer Road, on the east side of Penle Drive; and WHEREAS, a portion of said property has not been developed and the Plan Commission, sitting as a Zoning Commission, considered the petition of KCN Development Corporation to construct three (3) condominium buildings with a total of 104 units on the vacant portion of said property; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after having considered the recommendation of said Plan Commission, find and believe that the prior Special Use Permits should be amended to permit the use as proposed. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted an amendment to Ordinance No. 1195 and Ordinance No. 1672 thereby granting a Special Use Permit to KCN Development Corporation to permit the construction of three (3) condominium buildings, totaling 104 units subject to the following conditions: 1. The roof height shall not exceed 59 feet 10 inches. 2. The construction of parapet walls is permitted as depicted on sheet 3 of construction plans prepared by Haylock Design, revision dated 4-21-03, subject to Village staff approval of the development plan. Section 2: That this ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE. AYES: 6 NAYS: 0 ABSENT., 0 PASSED this 14th day of October 2003.
