HomeMy WebLinkAboutORDINANCE - 2905 - 8/20/2002 - SPECIAL USE/FIRST AMERICAN BANKORDINANCE NO. 2905 AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO ALLOW DRIVE-THRU LANES ON PROPERTY WITHIN A B-2 GENERAL BUSINESS DISTRICT AND TO AMEND A PREVIOUSLY APPROVED ANNEXATION AGREEMENT TO PERMIT A USE WHICH IS NOT CONDUCTED WITHIN AN ENCLOSED STRUCTURE AND THE SCREENING OF ROOF -TOP MECHANICAL EQUIPMENT WITH A MATERIAL OTHER WHEREAS, the Plan Commission of the Village of Elk Grove Village, acting as a Zoning Commission, at a public hearing duly called and held according to law, considered the granting of a Special Use Permit to permit drive-thru lanes in a B-2 District and to amend a previously adopted Annexation Agreement for property located on the east side of Meacham Road south of Biesterfield Road; and WHEREAS, the Mayor and Board of Trustees of the village of Elk Grove Village, after having considered the recommendation and finding of said Plan Commission, find and believe that the granting of the Special Use Permit and the amending of the Annexation Agreement is in the best interest of the Village. NOW, THEREFORE BE IT ORDAINDED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage Illinois as follows: Section 1: That there be granted a Special Use Permit to allow drive-thru lanes in a B-2 General Business District on the proposed Lot 1 of property to be sub -divided, which property is located on the east side of Meacham Road south of Biesterfield Road in Elk Grove Village. 1 Section 2: That the Annexation and Development Agreement between the Village of Elk Grove Village and DRH Cambridge Homes, Inc., Chicago Trust Company, as Trustee under Trust Agreement dated March 23, 1964 and known as Trust No. 46684 and Thomas R. Schreiner IRA Rollover and First American Bank as Trustee under Trust Agreement dated December 28, 1992 and known as Trust No. I- 92-051 and Thomas R. Schreiner ("the Annexation Agreement"), which Annexation Agreement affects the subject property and has been previously approved by the Village, be amended by: (i) permitting a use of proposed Lot 1 of the Property for drive through facilities; (ii) permitting a use which is not conducted completely within an enclosed structure; and (iii) permitting the screening of roof -top mechanical equipment with a material other than that of the principal structure. Section 3: That this ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 20th day of August 2002.
