HomeMy WebLinkAboutORDINANCE - 2844 - 8/14/2001 - FIRE PREVENTION CODE AMENDEDORDINANCE NO. 2844 AN ORDINANCE AMENDING CHAPTER 3 FIRE PREVENTION CODE OF TITLE 5 OF THE VILLAGE CODE BY ADDING THERETO A NEW SECTION ESTABLISHING FEES FOR PREVENTABLE FALSE ALARMS WHEREAS, owners of fire protection systems have on many occasions subjected the Fire Department to respond to an alarm call where there was no basis for the call and the alarm was made as a result of the negligence or carelessness on the part of the owner or its agent; and WHEREAS, after a review by the Fire Department of the causes of said false alarms, it is clear that in most instances, said false alarms can be prevented; and WHEREAS, each false alarm transmitted to the Village C requires four (4) to five (5) emergency vehicles to respond to the call; and WHEREAS, the Fire Department is of the opinion that unless certain fees and/or penalties are put into place, owners of fire protection systems will continue to carelessly and negligently allow alarms to be engaged where in fact no fire or other casualty exists. NOW, THEREFORE BE IT ORDAINED, by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage Illinois as follows: Section 1: That Chapter 3 Fire Prevention Code of Title 5 of the Village Code be and the same is hereby amended as follows: 1. That Section 5-3-8 Penalties be renumbered to 5-3- 9. 2. That a new Section 5-3-8 entitled Preventable False Alarms/Fees be established, which Section shall read as follows: 5-5-8 Preventable False Alarm Owners of fire protection systems that transmit false alarms are subject to a preventable false alarm response fee should their fire alarm system transmit a preventable false alarm. Preventable false alarms are defined by those alarms that are caused by the careless and negligent acts of individuals within a protected structure who cause an alarm to be transmitted as a result of such careless or negligent act and/or who fail to follow the notification provisions of this code with respect to notifying the department of a repair, disconnect, installation of a new system or such other act or modification which would likely lead to a false alarm being signaled and thus cause an unnecessary Fire Department response. The preventable response fees are as follows: NUMBER OF ALARM PREVENTABLE FALSE ALARMS RESPONSE FEE 1 0 (warning to be issued) 2 thru 4 $350.00 5 thru 7 $450.00 8 or more $600.00 Section 2: That this ordinance shall be in published in pamphlet form by the Village Clerk. Section 3: That this ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
