HomeMy WebLinkAboutORDINANCE - 2846 - 8/14/2001 - ZONING VARIATION/952 FARGOORDINANCE NO. 2846 AN ORDINANCE GRANTING A VARIATION OF SECTION 3-6:D-3 OF THE ZONING ORDINANCE TO PERMIT THE CONSTRUCTION OF A FENCE WHICH WOULD ENCROACH APPROXIMATELY TEN (10) FEET INTO THE REQUIRED TWENTY-FIVE (25) FOOT SIDE YARD ON PROPERTY LOCATED 952 FARGO Avenue, ELK GROVE VILLAGE (TOWNE AIR FREIGHT, INC.) WHEREAS, the Zoning Board of Appeals, at a public hearing duly called and held according to law, considered the question of granting variation of Section 3-6:D-3 of the zoning ordinance to permit the construction of a fence which would encroach approximately ten (10) feet into the required twenty-five (25) foot front yard area on property located at 952 Fargo Avenue, Elk Grove Village; and WHEREAS, the Mayor and Board of Trustees, of the Village of Elk Grove Village after having considered the finding and recommendation of said Zoning Board of Appeals find and believe that sufficient hardship exists so as to justify the granting of said variation. NOW, THEREFORE BE IT ORDAINED, by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage Illinois as follows: Section 1: That there be granted a variation of Section 3- 6:D-3 of the Zoning Ordinance to permit the construction of a fence which would encroach approximately ten (10) feet into the required twenty-five (25) foot front yard area and be located in front of the building setback line along Fargo Avenue on property located at 952 Fargo Avenue, Elk Grove Avenue and legally described as follows: Lot 390 in Centex Industrial Park Unit 238, being a Subdivision in the Southwest 1/, of Section 27, Township 41 North, Range 11, East of the Third Principal Meridian, according to the Plat thereof Recorded June 11, 1979 as Document 24997691 in Cook County, Illinois, Excepting therefrom the northeasterly 10 feet thereof adjacent to Landmeier Road (as measured at right angles to the northeasterly line of said Lot 390). Section 2: That this variation is subject to the condition that the petitioner use black fence posts and rails and to otherwise construct the fence with the approval of the Village Engineering Department. Section 3: That this ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 14th day of August 2001.
