HomeMy WebLinkAboutORDINANCE - 2851 - 9/13/2001 - ZONING VARIATION/506 BRYNHAVEN CTORDINANCE NO. 2851 AN ORDINANCE GRANTING A VARIATION OF THE ZONING ORDINANCE PERTAINING TO STRUCTURES IN THE SIDE YARD SETBACK AREA TO PERMIT THE CONSTRUCTION OF A DETACHED GARAGE ON PROPERTY LOCATED AT 506 BRYNHAVEN COURT, ELK GROVE VILLAGE (O'CONNOR) WHEREAS, the Zoning Board of Appeals at a public hearing duly called and held according to law considered the question of granting a variation of the zoning ordinance pertaining to detached accessory structures within six (6) feet of the side lot line and other variations; and WHEREAS, the Zoning Board of Appeals denied variations pertaining to more than one (1) detached structure on a lot and denied a variation for a detached structure exceeding 25 foot in length on any one side and more than 600 square feet in area but approved the variation of Section 3-6:D.2 to permit the construction of the detached structure in the side yard area; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after having considered the recommendation and finding of said Zoning Board of Appeals, find and believe that sufficient hardship exists so as to justify the granting of the approved variation. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a variation of Section 3- 6:D.2 of the zoning ordinance to permit a detached accessory structure to be located within six (6) feet of the side lot line and which would encroach approximately two (2) feet into the ten (10)foot utility easement on property located at 506 Brynhaven Court, Elk Grove Village and legally described as follows: Lot 309 in Elk Grove Village Section 1 North, being a Subdivision in the Southeast quarter of Section 21, Township 41 North, Range 11, East of the Third Principal Meridian, according to the Plat thereof recorded in the Office of the Recorder of Deeds on January 21, 1957 as Document Number 16806228 and filed in the Office of the Registrar of Titles of Cook County, Illinois on January 21, 1957 as Torrens Document LR1718827, in Cook County, Illinois Section 2: That this variation is conditioned upon the owners of the property removing the existing storage shed so that upon completion of the detached structure herein approved, there will exist only one (1) detached accessory structure on the property. Section 3: That this ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 5 NAYS: 0 ABSENT: 1 PASSED this 13th day of September 2001.
