AN ORDINANCE GRANTING A VARIATION OF SECTION 7A -1:B3 -b OF THE
ZONING ORDINANCE PERTAINING TO THE INSTALLATION OF CLOSED FENCES
TO PERMIT THE INSTALLATION OF A FENCE THAT WOULD EXTEND TEN (10)
FEET UP THE NORTH SIDE OF THE HOUSE AND THREE (3) FEET FROM THE
SIDEWALK ON PROPERTY LOCATED AT 1835 MAINE DRIVE, ELK GROVE
VILLAGE (RASE)
WHEREAS, the Zoning Board of Appeals at a public hearing
duly called and held according to law, considered the question of
granting a variation of Section 7A -1:B3 -b of the zoning ordinance
pertaining to the location of closed fences in order to permit
the installation of a fence that would be located within three
(3) feet of the side property line and encroach ten (10) feet up
the north side of the house's rear corner on property located at
1835 Maine Drive and legally described hereinafter; and
WHEREAS, the petitioner amended his initial application
pursuant to the request of the Zoning Board of Appeals and
thereafter the Zoning Board of Appeals approved the amended
application; and
WHEREAS, the Mayor and Board of Trustees of the Village of
Elk Grove Village, after having reviewed the finding and
recommendation of the Zoning Board of Appeals, find and believe
that sufficient hardship exists so as to justify the granting of
said variation.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook
and DuPage, Illinois as follows:
Section 1: That there be granted a variation of Section
7A -1:B3 -b of the zoning ordinance to permit the installation of a
solid fence that would extend ten (10) feet up the north side of
the house and be located three (3) feet from the sidewalk on
property located at 1835 Maine Drive, Elk Grove Village and
legally described as follows:
Lot 69 in Plat of Resubdivision Number 5, for a
portion of Winston Grove Section 23 "B", being
a Resubdivision of part of Section 26, Township
41 North, Range 10, East of the Third Principal
Meridian, in Cook County, Illinois
Section 2: That a condition in the granting of this
variation is that the fence to be installed shall match the fence
located on the neighboring property located at 1820 Bangor Lane.
Section 3: That this ordinance shall be in full force and
effect from and after its passage and approval according to law.
