HomeMy WebLinkAboutORDINANCE - 2860 - 10/30/2001 - ZONING VARIATION/1808 MARYLAND DRORDINANCE NO. 2860 AN ORDINANCE GRANTING A VARIATION OF SECTION 3-6:D.4 OF THE ZONING ORDINANCE TO PERMIT AN ABOVE GROUND SWIMMING POOL AND A SURROUNDING DECK TO BE LOCATED 2.5 FEET INTO THE REQUIRED 8.0 FOOT SETBACK ALONG THE REAR PROPERTY LINE AND 2.0 FEET INTO THE REQUIRED 8.0 FOOT SIDE PROPERTY LINE ON PROPERTY LOCATED AT 1808 MARYLAND DRIVE, ELK GROVE VILLAGE (BRADLEY) WHEREAS, the Zoning Board of Appeals, at a public hearing duly called and held according to law, considered the question of granting a variation of Section 3-6:D.4 of the Zoning Ordinance to permit a swimming pool and surrounding deck to be located 2.5 feet into the required 8 foot rear setback area and 2.0 feet into the required 8.0 foot side setback area on property located at 1808 Maryland Drive, Elk Grove Village and legally described hereinafter; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after having reviewed the findings and recommendation of said Zoning Board of Appeals, find and believe that sufficient hardship exists so as to justify the granting of said variation. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage Illinois as follows: Section 1: That there be granted a variation of Section 3- 6:D.4 of the Zoning Ordinance to permit an above -ground swimming pool with a surrounding deck to be located 2.5 feet into the required 8.0 foot rear setback area and 2.0 feet into the required 8.0 foot side setback area on property located at 1808 Maryland Drive, Elk Grove Village, Illinois and legally described as follows: Lot 17 Plat of Subdivision No. 5 for a portion of Winston Grove Section 23B, being a Subdivision of Part of Section 26, Township 41 North, Range 10, East of the Third Principal Meridian, in Cook County, Illinois, Recorded on October 7, 1986, as Document No. 86462249, and corrected by Certificate of Correction recorded on October 15, 1986, as Document No. 86477041. Section 2: That this ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 5 NAYS: 0 ABSENT: 1 PASSED this 30th day of October 2001.
