HomeMy WebLinkAboutORDINANCE - 2866 - 11/13/2001 - RAFFLES, AMENDING SECTIONSORDINANCE NO. 2866 AN ORDINANCE AMENDING VARIOUS SECTIONS OF SECTION 6-8-3 RAFFLES OF THE VILLAGE CODE WHEREAS, on June 12, 2001, the Village adopted Ordinance 2837, which Ordinance created regulations for charitable organizations and the like to conduct raffles within the Village of Elk Grove Village; and WHEREAS, after a review of the various procedures and regulations involved in the raffle process, it is deemed necessary and in the best interest of the Village to amend various provisions of Section 6-8-3. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the last sentence of Section 6-8-3-B-1 pertaining to the License Fee To Conduct a Raffle be deleted and in its place insert the following sentence: As a result of the charitable nature of eligible organizations, the fee for each license shall be deemed waived for each and every applicant. Section 2: That Section 6-8-3-B-2 be deleted in its entirety and in its place insert the following sentence: Any person desiring to secure a license to conduct a raffle pursuant to the provisions of this subchapter shall make an application to the Village Clerk upon a form provided by the Village. The Village Clerk shall act upon all such applications within 30 days from the date of application. Appeals to any denials by the Village Clerk to an application shall be made to the Village Manager within 5 days of the receipt of notification of denial. The Village Manager shall render the final decision on an appeal within 30 days from receipt of the appeal. 1 Section 3: That a new section 6-8-3-B(d) be created by the insertion of the following sentence: d. Any person or organization failing to comply with any of the provision of the Illinois Raffle Act (230 ILCS 15/0.01 et. Seq.). Section 4: That 6-8-3-C(1)(2)(3)(4)(5) be deleted in its entirety and replaced as follows: C. Restrictions: The conducting of raffles is subject to all of the provisions of the Illinois Raffles Act (230 ILCS 15 Section 4 and 230 ILCS 15 Section 5 or as amended). As a condition of an Elk Grove Village Raffle License, it is incumbent upon each applicant for a raffle license to familiarize themselves with and abide by the Illinois Raffles Act and any restrictions, requirements, changes, or amendments to said Act. Section 5: That this ordinance shall be in full force and and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ASSENT: 0 PASSED this 13th day of November, 2001.
