AN ORDINANCE REZONING PROPERTY LOCATED AT THE NORTHEAST CORNER OF
HIGGINS ROAD AND KING STREET FROM THE B-1 BUSINESS DISTRICT TO
THE B-3 BUSINESS DISTRICT AND GRANTING CERTAIN VARIATIONS WITH
RESPECT TO PARKING AND STACKING LANES (THIRD DUNKIN' DONUTS
REALTY, INC.)
WHEREAS, the Plan Commission, acting as a Zoning
Commission, held a public hearing to consider the question of
rezoning property located at the northeast corner of Higgins Road
and King Street from the B-1 Business District to the B-3
Business District and the granting of variations to reduce the
number of required drive-thru stacking spaces from twelve (12) to
seven (7) and reduce the number of required parking spaces from
twenty-seven (27) to twenty-six (26) for the operation of a 24 -
Hour Dunkin' Donuts and Togo's Sandwich Restaurant with a drive-
thru facility; and
WHEREAS, the Mayor and Board of Trustees of the Village of
Elk Grove Village, after having considered the recommendation and
finding of said Plan Commission find and believe that it is in
the best interest of the Village to have the property rezoned as
requested and grant the variations related thereto.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook
and DuPage Illinois as follows:
Section 1: That the property located at 700 East Higgins
Road which is on the northeast corner of Higgins Road and King
Street be and the same is hereby rezoned from the B-1 Business
District to the B-3 Business District subject to the requirement
that the owner develop the property in conformance with the
amended site plan approved by the Plan Commission as well as the
landscaping plan to be approved by the Plan Commission.
Section 2: That there be granted variations of the zoning
ordinance as follows:
a. To reduce the number of required drive-thru
stacking spaces from twelve (12) to seven (7); and
b. To reduce the number of required parking spaces
from twenty-seven (27) to twenty-six (26).
Section 3: That this ordinance shall be in full force and
effect from and after its passage and approval according to law.

PASSED this 3" day of December, 2001.
