HomeMy WebLinkAboutORDINANCE - 2886 - 4/9/2002 - ZONING VARIATION/BUSSE & LANDMEIERORDINANCE NO.2886 AN ORDINANCE GRANTING A VARIATION OF SECTION 3-7:D-3 AND SECTION 7E-S:A PERTAINING TO THE LOCATION AND HEIGHT OF FENCES IN AN INDUSTRIAL ZONED DISTRICT TO PERMIT A FENCE WHICH WOULD BE LOCATED IN FRONT OF BUILDING SETBACK LINES AND WITHIN THE REQUIRED FRONT YARD ALONG BUSSE AND LANDMEIER ROADS, PORTIONS OF WHEREAS, the Zoning Board of Appeals, at a public hearing duly called and held according to law, considered the question of granting a variation of Section 3-7:D-3 and Section 7E -8:A of the Zoning Ordinance pertaining to the height and location of fences in the Industrial District to permit the construction of a fence that would be located in front of the building setback lines and portions of which will exceed 8 feet in height on property located at 1001 Busse, Elk Grove Village; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after having considered the finding and recommendation of said Zoning Board of Appeals, find and believe that sufficient hardship exists so as to justify the granting of said variation. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a variation of Section 3- 7:D-3 and Section 7E-B:A of the Zoning Ordinance to permit the construction of a fence which would be located in front of building setback lines and within the required front yard along Busse and Landmeier Roads, portions of which will measure 8 feet in height on property located at 1001 Busse Road, Elk Grove Village, Illinois subject to the condition that the owner will eliminate barbed wire fencing at the top of said fences and will provide a landscaping plan compatible with the discussion on record at the Village Board meeting of March 26, 2002. Section 2: That this ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 9th day of April,2002.
