AN ORDINANCE GRANTING A VARIATION OF SECTION 3-7:B AND 3-7:D.1 OF
THE ZONING ORDINANCE TO PERMIT THE CONSTRUCTION OF A BASEMENT
STAIRWELL WITH RETAINING WALLS AND LANDING THAT WOULD ENCROACH
APPROXIMATELY SEVEN (7) FEET INTO THE REQUIRED TWENTY-FIVE (25)
FOOT SETBACK ALONG THE SIDE STREET FRONTAGE OF PROPERTY LOCATED
WHEREAS, the Zoning Board of Appeals, at a public hearing
duly called and held according to law, considered the question of
granting a variation of Sections 3-7:B and 3-7:D.1 of the Zoning
Ordinance pertaining to structures in the required twenty-five
(25) foot front yard area in order to permit the construction of
a basement stairwell with concrete retaining walls and a landing
that would encroach approximately seven (7) feet into said
twenty-five foot (25) setback; and
WHEREAS, the Mayor and Board of Trustees of the Village of
Elk Grove Village find and believe that sufficient hardship
exists so as to justify the granting of said variation.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Trustees of
the Village of Elk Grove Village, Counties of Cook and DuPage,
Illinois as follows:
Section 1: That there be granted a variation of Section 3-
7:B and Section 3-7:D.1 of the Zoning Ordinance to permit the
construction of a basement stairwell with concrete retaining
walls and a landing that would encroach approximately seven (7)
feet into the required twenty-five (25) foot setback along the

side street frontage on property located at 998 Leicester Road,
Elk Grove Village.
Section 2: That this ordinance shall be in full force and
effect from and after its passage and approval according to law.
VOTE: AYES: 6 NAYS: 0 ABSENT: 0
PASSED this 23rd day of April 2002.
