AN ORDINANCE AMENDING TITLE 3, CHAPTER 6, ARTICLE B, CIGARETTE
AND TOBACCO DEALERS, SECTION 3-6B-6 OF THE VILLAGE CODE OF THE
VILLAGE OF ELK GROVE VILLAGE AS IT PERTAINS TO SUSPENSION OR
REVOCATION OF LICENSE
BE IT ORDAINED by the Mayor and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage,
Illinois as follows:
Section 1: That Section 3-6B-6 Administration of
Provisions; Suspension or Revocation of License: of the Village
Code be and the same is hereby amended to read as follows:
3-6B-6: ADMINISTRATION OF PROVISIONS; SUSPENSION OR REVOCATION
OF LICENSE: The Mayor shall be charged with the
administration of this Article. In case of a first
violation of the provisions of this Chapter, the
licensee shall be advised by the Mayor or his
designated agent of the violation and further advised
that any subsequent violation within a one year period
will result in a hearing before the Mayor. At said
hearing, upon a finding of guilty or admission of
guilt, the Mayor may levy a fine in the amount set
forth in Section 3-6B-7 and in addition, may suspend
or revoke the license depending upon the facts and
circumstances of the case at hand. Notice of the
hearing shall be provided at least five days before
the date scheduled for the hearing. The decision of
the Mayor shall be deemed final.
Every act or omission of whatsoever nature,
constituting a violation of any of the provisions of
this Article, by any officer, director, manager or
other agent or employee of any licensee shall be
deemed and held to be the act of such licensee; and
such licensee shall be subject to such penalties as if
such act or omission had been done or omitted by the
licensee personally.
Section 2: That any person, firm or corporation violating
any of the provisions of this Ordinance shall be subject to such
fine as set forth in Section 3-6B-7 of the Village Code.
Section 3: That the Village Clerk is hereby authorized to
publish this Ordinance in pamphlet form.
Section 4: That this Ordinance shall be in full force and
effect from and after its passage, approval and publication
according to law.
