AN ORDINANCE GRANTING A VARIATION OF SECTION 7E -7-6:C OF THE
ZONING ORDINANCE TO PERMIT THE INSTALLATION OF A 1,000 GALLON
PROPANE TANK THAT WOULD BE LOCATED LESS THAN FIFTY (50) FEET FROM
ABUTTING LOT LINES ON PROPERTY LOCATED AT 795 TOUHY AVENUE, ELK
GROVE VILLAGE (BATTISTA)
WHEREAS, the Zoning Board of Appeals, at a public hearing
duly called and held according to law, considered the question of
granting a variation of Section 7E -7-6:C of the Zoning Ordinance
as it pertains to allowable location for above ground fuel
storage tank in an I-2 General Industrial District to permit the
installation of a 1,000 gallon propane tank in a location less
than fifty (50) feet from abutting lot lines; and
WHEREAS, the Mayor and Board of Trustees of the Village of
Elk Grove Village, after having considered the finding and
recommendation of said Zoning Board of Appeals, find and believe
that sufficient hardship exists so as to justify the granting of
said variation.
NOW, THEREFORE BE IT ORDAINED by the Mayor and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook
and DUPage Illinois as follows:
Section 1: That there be granted a variation of Section
7E -7-6:C of the Zoning Ordinance as it pertains to the location
of above ground fuel storage tanks in an I-2 General Industrial
District to permit the installation of a 1,000 gallon propane
tank that would be located thirty-one (31) feet from the west
side property line, forty-two (42)feet from the east side lot
line, and twenty-five (25) feet from the south property line on
property located at 795 Touhy Avenue, Elk Grove Village and
legally described as follows:
Lot 378 in Centex Industrial Park Unit 231, being
a Subdivision in Section 34, Township 41 North,
Range 11, East of the Third Principal Meridian,
in Cook County, Illinois according to the Plat
thereof recorded August 16, 1978 as Document No.
24586575.
Section 2: That this Ordinance shall be in full force and
effect from and after its passage and approval according to law.
