AN ORDINANCE REZONING CERTAIN PROPERTY AND GRANTING A
SPECIAL USE PERMIT AND VARIATIONS FROM THE ZONING
ORDINANCE AND SUBDIVISION CONTROL ORDINANCE (West Side of
Park Boulevard and North of Devon Avenue)
WHEREAS, Concord Development Corporation (Concord) is the
contract purchaser of certain property legally described in
Exhibit A attached hereto and made a part hereof; and
WHEREAS, said property consists of approximately 18.5 acres
located northwest of the intersection of Park Boulevard and Devon
Avenue and is presently zoned 0-T Office Transitional; and
WHEREAS, Concord has filed a petition with the Village for
reclassification of the property to the A-2 Multi -Family
Residential District and for the granting of a Special Use Permit
for the construction of a planned residential development and for
certain zoning ordinance and subdivision control ordinance
variations concerning their development of said property; and
WHEREAS, pursuant to a public notice published in the Daily
Herald, a newspaper of general circulation within the Village, and
such other notice being posted as required by Village Ordinance, a
Public Hearing was held by the Plan Commission of the Village with
regard to the Petition for Rezoning, the Petition for the Special
Use Permit and for the variations associated therewith; and
WHEREAS, the President and Board of Trustees of the Village
of Elk Grove Village, after having considered the findings and
recommendation of said Plan Commission find and believe that it is
in the best interest of the Village to rezone the property as
requested and grant a Planned Development and Special Use Permit
to the developer, and grant such variations as are deemed
appropriate subject to certain development conditions hereinafter
set forth.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage Illinois as follows:
1. That the property legally described on Exhibit A,
attached hereto, be in the same is hereby rezoned from the O -T
Office Transitional District to the A-2 Multi -Family District and
the official zoning map of the Village is hereby amended
accordingly.

2. That a Special Use Permit be in the same is hereby
granted to permit the development of 102 single-family attached
homes, said homes to be constructed in accordance with: (a) the
preliminary P.U.D. plat prepared by JEN Land Design, Inc. and
dated January 26, 1999, (b) the preliminary engineering plan
prepared by Manhard Consulting, Ltd. and dated January 27, 2000;
and (c) the preliminary landscape plan prepared by Pugsley &
Lahaie, Ltd. and dated January 27, 2000, all of said plans being
hereby approved by the Village, with copies of said plans being
on file in the office of the Village Clerk.
3. That a variation of the zoning ordinance pertaining to
right-of-way width is hereby granted to permit the width of 50 feet
for the interior street of the development. A variation from the
Subdivision Control ordinance is granted allowing a reduction in
the required open space from 50$ to 49.51% of the total side area.
4. That the granting of the rezoning Special Use Permit and
the variations above set forth is subject to the following
conditions:
• That a package of soundproofing improvements be
offered to potential homebuyers for each unit;
• That soundproofed windows and walls be installed in
the west elevation of all end units facing the
expressway (units 15, 16, 31, 32, 40, 41, 69,70, 90
and 91);
• That soundproofed windows and walls be included in
the exteriors of the west elevations of units 60-65
to the satisfaction of the Village;
• Letters of Awareness be provided to each potential
homebuyer as notice of the proximity of the I-290
expressway, the fact that no sound barrier walls
will be built to serve the development, and that the
home seller has explained the availability of a
soundproofing improvements at the homebuyer's cost.
The Letters of Awareness, in a form approved by the
village, are to be recorded against each unit;
• That permanent access to the Village's well site be
provided, as noted on said site plan, with an
asphalt surface meeting a structural number of 2.5;
• That the newly formed Homeowners Association will
assume a proportional cost of maintaining the Park
Boulevard medians with the Talbot's Mill Homeowners
Association;

• That screening be provided on the western and
northern boundaries of the subject property, with
the exception of the portion along the conservation
area, in the form of a continuous landscaped berm no
less than 3 feet in height, with an 8 -foot tall
stockade fence with brick piers every 50 -feet on
center, as depicted in the preliminary landscape
plan prepared by Pugsley & Lahaie, Ltd. and dated
January 27, 2000;
• That the developer shall include at a minimum 3
different colors of siding on the units throughout
the entire development to the satisfaction of the
Village;
• That the developer shall prepare the 1.85 acre park
site, as depicted on said preliminary P.U.D. site
plan, to the satisfaction of the Elk Grove Park
District, and donate said park site to the Village.
• That screening in the form of 4 -foot tall board on
board fencing be installed at the ends of the motor
courts facing the Talbot's Mill Subdivision as
depicted on said landscape plan.
5. The Village Clerk is hereby authorized to publish this
Ordinance in pamphlet form.
6. That this Ordinance shall be in full force and effect
from and after its passage, approval and publication as provided
by law.
