HomeMy WebLinkAboutORDINANCE - 2735 - 2/8/2000 - LIQUOR COMMISSIONER, HEARINGS BEFOREORDINANCE NO. 2735 AN ORDINANCE AMENDING TITLE 3, CHAPTER 3, SECTION 3-3-12C. OF THE VILLAGE CODE OF THE VILLAGE OF ELK GROVE VILLAGE PERTAINING TO HEARINGS BEFORE THE LOCAL LIQUOR COMMISSIONER AND SANCTIONS WHICH MAY BE IMPOSED BY THE LIQUOR COMMISSIONER FOR VIOLATIONS OF VILLAGE ORDINANCE OR STATE STATUTE NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DUPage Illinois as follows: Section 1: That Section 3-3-12C of the Village Code be in the same is hereby amended to read as follows: C. VIOLATION - FINE, SUSPENSION OR REVOCATION OF LICENSE: The local Liquor Control Commissioner shall have the right to hold a hearing for any licensee upon whom a Notice of Violation has been served and to examine or cause to be examined the books and records of any such licensee, to hear testimony and take proof for his information in the performance of his duties and for such purpose, to issue subpoenas which shall be effective in any part of this state, all has provided and in the manner provided by law. If, after a hearing on an alleged violation, the Village President, as Local Liquor Control Commissioner, finds that there was any violation of the Ordinances of the Village or Statues of the State of Illinois, he may suspend or revoke any retail liquor dealers license and/or fine any such licensee for any violation of any provision of this Chapter or for the violation of any State Law pertaining to the sale of alcoholic liquor. If the Commissioner determines to suspend such license, the term of the suspension shall not be less than one (1) day nor more than thirty (30) days. If the Commissioner elects to fine such licensee, the amount of such fine shall not be less than $250.00 nor more than $2,500.00 for each offense. In addition to such fine, the Commissioner is further authorized to assess the licensee for all costs associated with the hearing including attorneys fees and court reporter fees. Section 2: The Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
