AN ORDINANCE GRANTING A VARIATION OF SECTION 3-6:D-3 OF THE
ZONING ORDINANCE PERTAINING TO THE LOCATION OF FENCES IN THE
REQUIRED FRONT YARD AREA TO PERMIT THE INSTALLATION OF A FOUR (4)
FOOT HIGH FENCE ON PROPERTY LOCATED AT 1450 JAMES WAY, ELK GROVE
VILLAGE (JANUSCH)
WHEREAS, the Zoning Board of Appeals at a public hearing
duly called and held according to law, considered the question of
granting a variation of Section 3-6:D-3 of the Zoning Ordinance
to permit the installation of a four (4) foot high fence which
would encroach into the twenty-five (25) foot required front yard
along James Court on property located at 1450 James Way, Elk
Grove Village and legally described hereinafter; and
WHEREAS, the President and Board of Trustees, after having
considered the recommendation and finding of said Zoning Board of
Appeals, find and believe it to be in the best interest of the
Village that said variation be granted.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook
and DuPage Illinois as follows:
Section 1: That there be granted a variation of Section
3-6:D-3 of the Zoning Ordinance, as it pertains to fences being
installed in the required front yard area, to permit the
installation of a four (4) foot high fence which would encroach
into the twenty-five (25) foot required front yard along James
Court on property located at 1450 James Way, Elk Grove Village
and legally described as follows:
Lot 1 in Block 8 in Elk Grove Village Section 20, being a
Subdivision in Section 36, Township 41 North, Range 10,
East of the Third principal Meridian, According to the Plat
Thereof Recorded in the Recorder's Office of Cook County,
Illinois on August 24, 1973 as Document No.22452761, in
Cook County, Illinois.
Section 2: That this Ordinance shall be in full force and
effect from and after its passage and approval according to law.
VOTE: AYES: 4 NAYS: 0 ABSENT: 2
