HomeMy WebLinkAboutORDINANCE - 2761 - 6/27/2000 - ANNEXING AND REZONINGORDINANCE NO. 2761 AN ORDINANCE ANNEXING CERTAIN PROPERTY AND REZONING CERTAIN PROPERTY IN THE VILLAGE OF ELK GROVE VILLAGE SWEET TRADITIONS, L.L.C., FRANCHISEE OF KRISPY KREME DOUGHNUTS (418 E. DEVON AVE.) WHEREAS, a written petition has been filed with the Village Clerk of the Village of Elk Grove Village by Edwin H. Baehr and Linda M. Baehr, said petition seeking annexation to the Village of Elk Grove Village of certain land and territory legally described hereinafter; and WHEREAS, said land and territory is not within the corporate limits of any municipality but is contiguous to the Village of Elk Grove Village; and WHEREAS, any Fire Protection District, Library District, Township Road Commissioner, County Clerk or other entity or person entitled to notice prior to the annexation of the subject property has been given such notice as is required by law; and WHEREAS, the President and Board of Trustees find and believe it to be in the best interest of the Village that said land and territory be annexed to the Village according to the conditions and provisions of this Ordinance. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the land and territory, legally described on Exhibit A, attached hereto and by this reference incorporated herein, which land and territory is contiguous to the Village of Elk Grove Village, and not within the limits of any other municipality, be and the same is hereby annexed to the Village of Elk Grove Village, so that said territory shall be included within the boundary limits of said Village as is by law in such case made and provided. Section 2: In conjunction with a Public Hearing before the Plan Commission of the Village of Elk Grove Village, the Village hereby rezones the property annexed herein to the B-2 General Business District. Further, the Village hereby approves the preliminary plat of subdivision for the property and for the adjoining property that has been submitted to the Village by Sweet Traditions, L.L.C. (the " Preliminary Plat of Subdivision" ). Section 3: That the annexation of the property is subject to the following conditions: a. Annexation fees of $500.00 per acre shall be paid upon annexation of the property to the Village of Elk Grove Village, which funds shall be placed in the Municipal Purpose Fund of the Village. b. Upon annexation, the owner shall have sixty (60) days to provide the Village with a Final Plat of Subdivision for the property and for the adjoining property in substantial conformance to the Preliminary Plat of Subdivision as prepared by Spaceco, Inc., last revised, May 26, 2000. The Plat of Subdivision must be approved by the Director of Engineering and Community Development prior to the issuance of any Building or Engineering Permits, which approval shall not be unreasonably with -held provided the Final Plat of Subdivision substantially conforms to the Preliminary Plat of Subdivision. C. Engineering Plans approved by the Village Engineer, shall be submitted prior to the issuance of any Building or Engineering Permits. d. Upon annexation, the owner shall have no more than ninety (90) days to demolish the existing residential structure on the property, in accordance with applicable Village Ordinances. 2 Section 4: That the Village Clerk of the Village of Elk Grove Village is directed to record a certified copy of this Ordinance together with a Plat of Annexation of said territory with the Recorder of Deeds of Cook County, Illinois. Section 5: That the Village Clerk is directed to amend the Official Village Map in accordance with the provisions of this Ordinance. Section 6. That the Village Clerk is authorized to publish this Ordinance in pamphlet form. Section 7. That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTE: AYES: Trustees: N. Cz C. Prochno NAYS: B. Dill, P. Feichter, J.
