Kozor, Plan Reviewer/Inspection Supervisor, Community Development Zoning Variation — Docket #21-4 951 Borman Court Chairman Childress called the meeting to order at 7:00 pm and read a statement describing the hearing notification procedure as well as the legal notice. The petitioner, Juan Nevarez (Owner of Record), was sworn in and asked to state his case for requesting a zoning variation. The petitioner's hardship is a fence installed in a location compliant with the Zoning Code would reduce the yard size due to the location of the existing trees and patio. The orientation of this house and lot along with the adjacent house and lot would require the fence to cut through his patio.. The petitioner stated that he is a new resident, the current fence is in disrepair, and he has a small child that he would like to provide a privacy fence for. Chairman Childress opened the meeting to questions from the board. The board members discussed the location of the fence, its height, sight lines, and fence style. The petitioner stated that he had spoken to his neighbors regarding the new fence, informed them of the height change, and that none of the neighbors had an issue with the fence installation. Member Damptz Jr. inquired if the house had a variance for the fence, and how the current fence was originally permitted. Staff member Kozor responded that the existing fence did not have a variance and that the code had changed since the fence was initially built. This legal non -conforming fence is therefore required to receive a variance to be rebuilt. Member Damptz Jr. inquired if it would be difficult for the petitioner to relocate the existing fence back five (5') feet so the fence would not be located beyond the adjacent front corner of the principal structure. Chairman Childress opened the meeting to questions from the public. Scott Fox, 957 Borman Court, stated he had no concerns with the installation of the fence and was present to inquire what type of fence was proposed. Mr. Fox inquired if a solid type vinyl fence would be strong enough to withstand wind. Staff member Kozor presented Mr. Fox with photos of the solid style white vinyl privacy fence provided by the petitioner as examples of the fence that is proposed. Staff member Kozor stated that the solid style vinyl privacy fence is required to be installed per Elk Grove Village installation requirements and manufacture specifications. Chairman Childress called for the motion. A Motion to DO GRANT a variation to permit the installation of a six (6') foot high privacy fence which will extend approximately twenty-four (24') feet beyond the nearest front corner of the principal structure on the adjacent single-family residential lot to the north at 947 West Glenn Trail and extend approximately five (5') feet beyond the adjacent front corner of the principal structure. This Motion was made by Member Romanski which was seconded by Member Latrofa. Upon voting (AYES — Childress, Damptz Jr., Glimco, Latrofa, Romanski, and Spragg) (NAYES- None.) (ABSENT — Bookler, Colgan, and Serrano) The motion carried. Mr. Childress advised the petitioner to contact the Village Clerk and be available for the subsequent Village Board Meeting.
