DEVONORDINANCE NO. 2762 AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO PERMIT THE OPERATION OF A DRIVE-THROUGH FACILITY IN A B-2 GENERAL BUSINESS DISTRICT FOR PROPERTY LOCATED AT 412 EAST DEVON AVENUE AND A SPECIAL USE PERMIT FOR THE PRODUCTION OF GOODS FOR SALE ON THE PREMISES AND FOR DISTRIBUTION OFF THE PREMISES ON PROPERTY LOCATED AT 412 AND 418 EAST DEVON AVENUE, ELK GROVE VILLAGE (SWEET TRADITIONS, L.L.C., FRANCHISEE OF KRISPY KREME DOUGHNUTS) WHEREAS, the Plan Commission of the Village of Elk Grove Village, at a Public Hearing duly called and held according to law, considered the question of granting a Special Use Permit in accordance with 7B -2-2:E of the Zoning Ordinance to permit the construction and operation of a facility for the production of goods for sale on the premises and for distribution off the premises and for the operation of a drive-through facility in a B-2 General Business District on property located at 412 East Devon and 418 East Devon, Elk Grove Village and legally described hereinafter; and WHEREAS, the President and Board of Trustees, after reviewing the recommendation and finding of said Plan Commission, find and believe that it is in the best interest of the Village to grant a Special Use Permit as requested. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage Illinois as follows: Section l: That there be granted a Special Use Permit to Sweet Traditions, L.L.C. in accordance with Section 7B -2-2:E of the Zoning Ordinance to permit a facility for the production and warehousing of goods for sale on the premises and for distribution off the premises on properties located at 412 East Devon and 418 East Devon, Elk Grove Village and legally described on Exhibit A attached hereto and incorporated herein. Section 2: That there be granted a Special Use Permit to Sweet Traditions, L.L.C. to permit the operation of a drive- through facility in a B-2 General Business District on property located at 412 East Devon and legally described on Exhibit A attached hereto and incorporated herein. Section 3: That the above Special Use Permits granted herein are subject to the following conditions: a. That a common driveway be constructed along the east boundary of the subject property upon the annexation of the unincorporated parcel located immediately to the east of the subject property as depicted on site plans on file in the office of the Department of Engineering and Community Development. b. That a revised final landscape plan be submitted for approval to the Plan Commission. Section 4: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 5 NAYS: 0 ABSENT: 1 PASSED this 27th day of June 2000.
