HomeMy WebLinkAboutORDINANCE - 2768 - 6/27/2000 - ELK GROVE PARK DISTRICT/PARCEL OF LANDORDINANCE NO. 2768 AN ORDINANCE DECLARING THE NECESSITY AND CONVENIENCE OF THE USE AND OCCUPANCY OF PART OF THE DIVISION OF THE SOUTH Y2 OF SECTION 33, TOWNSHIP 41 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN PREAMBLE WHEREAS, the Village of Elk Grove Village is a municipal corporation and body politic of Cook and DuPage Counties, Illinois; and WHEREAS, the Village of Elk Grove Village and the Elk Grove Park District are municipalities as defined in "An Act In Relation To The Transfer Of Interest In Real Estate By Units Of Local Government Or School Districts, Approved July 2, 1925" (Chapter 50, Section 605 of Illinois compiled Statutes, 1996); and WHEREAS, the territory of said municipalities is wholly within, coextensive with or partly within and partly without the corporate limits of the other; and WHEREAS, transfer of interests in real estate are authorized by said Act between such municipalities upon such terms as may be agreed upon; and WHEREAS, the Elk Grove Park District is the present owner of a parcel of land for which it has no further use, described as follows: BEGINNING AT THE SOUTHEASTERLY CORNER OF ELK GROVE VILLAGE SECTION 8 BEING A SUBDIVISION IN THE EAST HALF OF SECTION 33, TOWNSHIP 41 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN; SAID SOUTHEASTERLY CORNER BEING THE INTERSECTION OF THE WEST LINE OF THE EAST 100.00 FEET OF THE SOUTHEAST QUARTER OF SAID SECTION 33 AND A POINT 99.81 FEET SOUTH OF THE SOUTHERLY LINE OF WALNUT LANE AS DEDICATED IN SAID ELK GROVE VILLAGE SECTION 8; THENCE CONTINUING SOUTH ALONG THE WEST LINE OF THE EAST 100.00 FEET OF THE SOUTHEAST QUARTER OF SAID SECTION 33 A DISTANCE OF 225.15 FEET TO THE POINT OF BEGINNING, SAID and POINT ALSO BEING THE INTERSECTION OF THE WEST LINE OF THE EAST 100.00 FEET OF THE SOUTHEAST QUARTER OF SAID SECTION 33 AND THE SOUTH LINE OF THE COMMONWEALTH EDISON ELECTRICAL TRANSMISSION RIGHT OF WAY, THENCE CONTINUING SOUTH ALONG THE WEST LINE OF THE EAST 100.00 FEET OF THE SOUTHEAST QUARTER OF SAID SECTION 33 A DISTANCE OF 269.44 FEET TO A POINT, SAID POINT ALSO BEING THE NORTHEASTERLY CORNER OF BOLGER'S ASSESSMENT PLAT BEING A SUBDIVISION OF PART OF THE SOUTH HALF OF THE SOUTHEAST QUARTER OF SAID SECTION 33; THENCE NORTH 12"31'00" EAST ALONG THE WESTERLY RIGHT OF WAY LINE OF TONNE ROAD A DISTANCE OF 298.67 FEET TO A POINT, SAID POINT ALSO BEING ALONG THE SOUTHERLY LINE OF THE COMMONWEALTH EDISON ELECTRICAL TRANSMISSION RIGHT OF WAY EXTENDED; THENCE SOUTH 68°51'45" WEST A DISTANCE OF 63.11 FEET TO THE POINT OF BEGINNING ALL IN COOK COUNTY, ILLINOIS. WHEREAS, it is necessary and convenient that the Village of Elk Grove Village use and occupy the aforesaid real estate for municipal street purposes in the interest of the health, safety and welfare of the citizens of the Village and people travelling through the area of the real estate. NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the terms and the provisions of the Preamble hereof are incorporated into this Ordinance by this reference. Section 2: That it is necessary and convenient for the Village of Elk Grove Village to use and occupy the aforesaid real estate for municipal street purposes. Section 3: That the Village of Elk Grove Village and the Village President and Board of Trustees thereof hereby indicate the intent of the Village of Elk Grove Village to accept a conveyance of said property from the Elk Grove Park District subject to restrictions and conditions of record but free and clear of all real estate taxes and special assessments. Section 4: That the President and Board of Trustees of the Village of Elk Grove Village be and are hereby authorized and directed to take such steps and to execute such documents as shall be necessary or advisable to accomplish the intent of this Ordinance. Section 5: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. VOTES: AYES: s NAYS: a ABSENT." 1 PASSED this ILLhday of June , 2000.
