AN ORDINANCE GRANTING A VARIATION OF SECTIONS 3-6:D.1 AND 7-1 OF
THE ZONING ORDINANCE PERTAINING TO PRINCIPAL STRUCTURES IN A
REQUIRED SIDE YARD TO PERMIT THE CONSTRUCTION OF A GARAGE
ADDITION THAT WOULD ENCROACH APPROXIMATELY THREE (3) FEET INTO
THE REQUIRED EIGHT (8) FOOT SIDE YARD ON PROPERTY LOCATED AT 1163
CUNNINGHAM CIRCLE, ELK GROVE VILLAGE (JASZCZUROWSKI)
WHEREAS, the Zoning Board of Appeals, at a Public Hearing
duly called and held according to law, considered the question of
granting a variation of Sections 3-6:D.1 and 7-1 of the Zoning
Ordinance as they pertain to principal structures in the required
side yard in order to permit the construction of a garage
addition that would encroach approximately three (3) feet into
the required side yard on property located at 1163 Cunningham
Circle, Elk Grove Village and legally described hereinafter; and
WHEREAS, the President and Board of Trustees, after having
reviewed the finding and recommendation of said Zoning Board of
Appeals, find and believe that sufficient hardship exists so as
to justify the granting of said variation.
NOW, THEREFORE, BE IT ORDAINED by the President and Board
of Trustees of the Village of Elk Grove Village, Counties of Cook
and DuPage Illinois as follows:
Section 1: That there be granted a variation of Section 3-
6:D.1 and 7-1 of the Zoning Ordinance as they pertain to
principal structures in a required side yard in R-3 zoning
districts west of Beisner Road, to permit the construction of a
garage addition that would encroach approximately three (3) feet
into the required side yard on property located at 1163
Cunningham Circle, Elk Grove Village and legally described as
follows:
Lot 5009 in Elk Grove Village Section 17, being a
Subdivision in Section 25 and Section 36, Township
41 North, Range 10, East of the Third Principal Meridian,
according to the Plat thereof recorded in the Office
of the Recorder of Deeds on November 14, 1969, as Document
Number 21013188, in Cook County, Illinois.
Section 2: That this Ordinance shall be in full force and
effect from and after its passage and approval according to law.
VOTE: AYES: 5 NAYS: 0 ABSENT: 1
