AN ORDINANCE AMENDING SECTION 4 OF ORDINANCE NO. 2130
PERTAINING TO CONNECTIONS TO MUNICIPAL SANITARY SEWER
SYSTEM (ILLINOIS DEPARTMENT OF TRANSPORTATION)
WHEREAS, the Village annexed property of land owned by The
State of Illinois Department of Transportation (IDOT) by Ordinance
No. 2130 on October 23, 1990;
WHEREAS, at the time of adoption of Ordinance No. 2130, the
Village and IDOT believed that the municipal sanitary sewer would be
installed by private property owners in a easterly direction to the
proximity of the intersection of Martha Street and Biesterfield
Road; and
WHEREAS, the extension of the municipal sanitary sewer has not
yet occurred; and
WHEREAS, IDOT has petitioned the Village to replace their
existing septic field in lieu of connecting to the Village's
sanitary sewer system as required under Ordinance No. 2130; and,
WHEREAS, the Village has determined that the installation of
the sanitary sewer would be cost prohibitive until the sanitary
sewer is extended east to Martha Street.
NOW, THEREFORE, BE IT ORDAINED by the President and Board
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage Counties, Illinois as follows:
Section 1: That Section 4 of Ordinance No. 2130 annexing the
IDOT property to the Village of Elk Grove be hereby amended to read
as follows:
Section 4: That, at such time as the Village's
municipal sanitary sewer is extended to the proximity
of Martha Street and Biesterfield Road, IDOT shall
immediately connect to the municipal sanitary sewer
system and properly seal its septic system.
Section 2: That this Ordinance shall be in full force and
effect from and after its passage, approval according to law.
