HomeMy WebLinkAboutORDINANCE - 2699A - 6/8/1999 - ANNEX/GULLO'S WOOD DALE OAKSORDINANCE NO. 2699A AN ORDINANCE ANNEXING CERTAIN PROPERTY TO THE VILLAGE OF ELK GROVE VILLAGE (GULLO'S WOOD DALE OAKS) WHEREAS, a written petition has been filed with the Village Clerk of the Village of Elk Grove Village by Giovanni and Maria Gullo Family Limited Partnership, said petition seeking annexation to the Village of Elk Grove Village of certain land and territory legally described hereinafter; and WHEREAS, said land and territory is not within the corporate limits of any municipality but is contiguous to the Village of Elk Grove Village; and WHEREAS, the proposed zoning of the property to be annexed is consistent with the zoning designated for said property by the Village's Comprehensive Plan and Official Map; and WHEREAS, any Fire Protection District, Library District, Township Road Commissioner, County Clerk or other entity or person entitled to notice prior to the annexation of the subject property has been given such notice as is required by law; and WHEREAS, the President and Board of Trustees find and believe it to be in the best interest of the Village that said land and territory be annexed to the Village according to the terms and provisions of this Ordinance. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the land and territory, legally described on Exhibit A, attached hereto and by this reference incorporated herein, which land and territory is contiguous to the Village of Elk Grove Village, and not within the limits of any other municipality, be and the same is hereby annexed to the Village of Elk Grove Village, so that said territory shall be included within the boundary limits of said Village as is by law in such case made and provided. Section 2: That the Village hereby grants I-1 Industrial Zoning to the property being annexed herein, said I-1 Zoning classification being the use designated for the property on the Village's Official Map. Section 3: That the annexation of the property is subject to the following conditions: a. Annexation fees of $500.00 per acre shall be paid upon annexation of the property to the Village of Elk Grove Village, which funds shall be placed in The Municipal Purpose Fund of the Village. b. Prior to the issuance of any Building Permits, proof shall be provided to the Village that the owners have paid to the City of Wood Dale, the sanitary sewer recapture fees assessed on owner's property and provide proof that the owner has permission to connect to the Wood Dale Sanitary Sewer Collection System. C. Upon annexation, the owner shall have sixty (60) days to provide the Village with a Final Plat of Subdivision. The Plat of Subdivision must be approved by the Director of Engineering and Community Development prior to the issuance of any Building or Engineering Permits. d. Engineering Plans, subject to the approval of the Director of Engineering and Community Development shall be submitted prior to the issuance of any Building or Engineering Permits and shall include the extension of public utility lines across the lot frontage. e. Owner will be responsible for extending a 12" diameter watermain along the entire Wood Dale Road frontage across the southerly property line and must interconnect with the existing Village watermain on Allan Drive. f. Owner will be responsible for all water charges of the Village of Elk Grove Village and all sanitary sewer charges of the Village of Elk Grove Village and the City of Wood Dale. Section 4: That the Village Clerk of the Village of Elk Grove Village is directed to record a certified copy of this Ordinance together with a Plat of Annexation of said territory with the Recorder of Deeds of DuPage County, Illinois. Section 5: That the Village Clerk is authorized to publish this Ordinance in pamphlet form. Section 6: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
