AN ORDINANCE AMENDING, IN THEIR ENTIRETY, TITLE 8, CHAPTERS 3D, 3E AND 3F
OF THE BUILDING ACTIVITY CODE
OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of
the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as
follows:
Section 1: That 8-3D-1. Be amended to read as follows:
A. Code Adopted: There is hereby adopted by reference as it
fully set out herein that certain code known as the
International Plumbing Code/1997, prepared and published by
the International Code Council, Inc. and the Building
Officials and Code Administrators International, Inc..
together with the additions, insertions, deletions and
changes hereinafter set forth, three (3) copies of which are
available for inspection are on file in the office of the
Village Clerk.
B. Amendments: The following additions, insertions, deletions
and changes are hereby made to the International Plumbing
Code:
1. Section 101.1: Insert "Elk Grove Village" as
indicated.
2. Section 106.5.2: Insert "As may be established from
time to time by the President and Board of Trustees".
3. Delete Section 106.5.3.
4. Section 108.4: Amend to read: As provided for by
Title 8, Chapter 3, Article G of this Municipal Code.
5. Delete Section 108.
6. Chapter 14: Add the most recently published edition
of the State of Illinois Plumbing Code prepared and
published by the Illinois Department of Public Health
to the referenced standards.
Section 2: That 8-3E-1 be amended to read as follows:
A. Code Adopted: There is hereby adopted by references as if
fully set out herein that certain code known as the
International Mechanical Code/1996 edition, prepared and
published by the International Code Council, Inc. together
with the additions, insertions, deletions and changes
hereinafter set forth, three (3) copies of which are
available for inspection and are on file in the office of
the Village Clerk.
B. Amendments: The following additions, insertions, deletions
and changes are hereby made to the International Mechanical
Code:
1. Section 101.1: Insert "Elk Grove Village" as
indicated.
2. Section 106.5.1: Delete in its entirety.
3. Section 106.5.2: Renumber to 106.5.1 and insert "As
may be established from time to time by the President
and Board of Trustees."
4. Section 106.5.3: Delete in its entirety.
5. Section 108.4: Amend to read: As provided for by
Title 8, Chapter 3, Article G of the Municipal Code.
6. Add new Section 1101.7 as follows:
1101.7
Use of Water for Comfort Air Conditioning. In all
apparatus of equipment installed for the purpose of
changing the dry bulb temperature or humidity content
of the air, whether used in conjunction with summer
comfort air conditioning or other refrigeration, the
following regulations shall apply:
a) The use of water -c prohibited when used
directly from t, mains as a cooling
medium in air washers or any type of
equipment whereby the air to be
conditioned comes into direct contact with
sprays or wet surfaces, or where the water
is used as the direct or indirect cooling
system medium in coils.
b) The use of water is permitted in all
compressor type refrigeration units having
standard rated capacities of one and one
half (1 ') tons or less.
c) All compressor type refrigeration units
having standard rated capacities of one
and one half (1 �) tons or over shall be
equipped with evaporate coolers and
condensers, water cooling towers, spray
ponds, other water cooling equipment so
that all water from the mains is used for
make up purposes only.
Note: In b) and c) capacities shall be in
accordance with conditions given in
Standard A.S.R.E. Testing and Rating
Codes.
d) If other than compressor types of
refrigeration units are used, the
consumption of water from the mains shall
be limited in amount to not more per ton
of refrigeration produced than would be
used by the compressor type described
under c) above when such type is operated
under normal conditions.
Section 3: That 8-3F-1 be amended to read as follows:
A. Code Adopted: There is hereby adopted by references as if
fully set out herein that certain code known as the BOCA
National Property Maintenance Code/1996, Fifth Edition,
prepared and published by the building Officials and Code
Administrators International, Inc., together with the
additions, insertions, deletions and changes hereinafter set
forth, three (3) copies of which are available for
inspection and are on file in the office of the Village
Clerk.
B. Amendments: The following additions, insertions, deletions
and changes are hereby made to the BOCA National Property
Maintenance Code:
1. Section PM -101.1: Insert "Elk Grove Village" as
indicated.
2. Section PM -105.8: Add text as follows:
In addition to the Department of Engineering and
Community Development, which Department is primarily
responsible for the enforcement of the Property
Maintenance Code, the Health Department shall be
responsible for enforcing those portions of the
Property Maintenance Code relating to health matters,
including, but not limited to the following:
Sections 303.0, 305.0, 306.0, 307.0, 503.0, 505.0,
506.0 and 507.0. The Health Coordinator shall be
authorized to enforce the health-related portions of
this code including the issuance of notices and
prosecution of violations according to the provisions
of this code. The Health Coordinator shall appoint
such number of officers, technical assistants,
inspectors and other employees as shall be necessary
for the administration of the applicable sections of
this code.
3. Section PM -304.15: Insert "April 1" and "December 1"
4. Section PM -602.2.1: Insert "October 1" and "May 15"
5. Section PM -602.3: Insert "October 1" and "May 15"
C. Additions: The following additions are hereby made to the
Property Maintenance Code:
1. Unfit Dwellings:
A. Designation of Unfit Dwellings:
(1) Any dwelling or dwelling unit shall be
designated as unfit for human habitation
when any of the following defects or
conditions are found and when, in the
judgement of the Engineering and Community
Development Department, such defect
creates a hazard to the health, safety or
welfare of the occupants or of the public.
(a) Is damaged, decayed, dilapidated,
unsanitary, unsafe and/or vermin -
infested and/or contains hazardous
levels of lead-based paint or other
substance.
(b) Lacks illumination, ventilation
and/or required sanitation
facilities.
(c) The general condition of location is
unsanitary, unsafe and/or
unhealthful.
(2) Whenever any dwelling or dwelling unit has
been designated as unfit for human
habitation. The Engineering and Community
Development Department shall placard the
dwelling or dwelling unit indicating it is
unfit for human habitation and, if
occupied, shall order such dwelling or
dwelling unit vacated within a reasonable
time, such time to be not less than
twenty-four (24) hours or more than three
(3) days.
(3) No dwelling or dwelling unit which has
been designated as unfit for human
habitation, has been placarded as such and
vacated shall be used again for human
habitation until written approval is
secured from the Engineering and Community
Development Department and the placard
removed by the Engineering and Community
Development Department.
(4) The Engineering and Community Development
Department shall rescind the designation
as unfit for human habitation and remove
the placard when the defect or condition
upon which such designation and placard
was based has been removed or eliminated
and the dwelling or dwelling unit is
deemed by the Engineering and Community
Development Department as a safe, sanitary
and fit place for human habitation.
(5) No person shall deface or remove the
placard from any dwelling or dwelling unit
which has been designated as unfit for
human habitation and has been placarded as
such, except as provided in subsection (4)
above.
(6) Any person affected by any decision of the
Engineering and Community Development
Department or by any designation or
placarding of a dwelling or dwelling unit
as unfit for human habitation shall be
granted a hearing on the matter before the
Engineering and Community Development
Department under the appropriate
procedures.
2. Emergencies: Whenever, in the judgement of the
Engineering and Community Development Department, an
emergency exists which requires immediate action to
protect the public health, safety or welfare, an order
may be issued, without a hearing or appeal, directing
the owner, occupant, operator or agent to take such
action as is appropriate to correct or abate the
emergency. If circumstances warrant, the Engineering
and Community Development Department may act to
correct or abate the emergency.
Section 4: That this Ordinance shall be in full force and effect from
and after its passage and approval according to law.
