HomeMy WebLinkAboutORDINANCE - 2713 - 9/14/1999 - ZONING ORDINANCE AMENDEDORDINANCE NO. 2713 AN ORDINANCE AMENDING SECTION 3-6:D OF THE ZONING ORDINANCE PERTAINING TO STRUCTURES IN YARDS BY AMENDING REGULATIONS FOR DETACHED ACCESSORY STRUCTURES AND PROVIDING FOR A DEFINITION OF AND REGULATIONS FOR STORAGE SHEDS WHEREAS, the Plan Commission of the Village of Elk Grove Village, at a Public Hearing duly called and held according to Law, considered the question of amending Section 3-6:D of the Zoning Ordinance as it pertains to accessory structures in required rear yards of property; and WHEREAS, the President and Board of Trustees, of the Village of Elk Grove Village, after having reviewed the recommendation and finding of said Plan Commission, find and believe it to be in the best interest of the Village that the Zoning Ordinance be amended pursuant to the findings of said Plan Commission. NOW THEREFORE BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Chapter 2 Definitions of the Zoning Ordinance be amended by inserting therein the following definition: Storage Shed: An accessory structure not exceeding 150 square feet in area used for the storage of items, other than vehicles, that are associated with the residential use of the primary structure. Section 2: That Section 3-6:D.2 of the Zoning Ordinance be amended to read as follows: 3-6:D.2 No detached accessory structure shall exceed a height of fifteen feet (151) measured from the finished grade to the highest point of the structure. Detached accessory structures shall not be located closer than sixty feet (60') to the front lot line, nor within the required side yard, nor occupy more than thirty percent (30%) of the required rear yard area provided the structure shall not be closer than six feet (6') to the rear lot line or the side lot line unless greater restrictions are required by easements. This paragraph shall not apply to storage sheds which are otherwise regulated pursuant to paragraph 6 hereafter. Section 3: That Section 3-6:D is hereby further amended by adding thereto, a new paragraph pertaining to storage sheds, which paragraph shall read as follows: Section 3-6:D.6 Storage sheds shall not be located closer than sixty feet (60') to the front lot line, nor, closer than two feet (2') to the side or rear lot line unless greater restrictions are required by easements. No storage shed shall exceed fifteen feet (15') in height measured from the finished grade to the highest point of the shed. Section 4: That any person, firm, or corporation who violates any provisions of this Ordinance shall be subject to such fines as are set forth in the Penalty Section of the Zoning Ordinance of the Village. Section 5: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 6: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication according to law.
