Zoning Variation — Docket #21-6 655 New Mexico Trail
Chairman Childress called the meeting to order at 7:00 p.m. and read a statement describing the hearing
notification procedure as well as the legal notice.
The petitioner, Laila Bashia (Owner of Record), was sworn in and asked to state her case for requesting a
zoning variation.
The petitioner's hardship is that they are wanting to replace an existing chain link fence that was
removed to access the exterior of the house when it was remodeled. The petitioner is seeking to provide
privacy and safety while maintaining the aesthetics of the subdivision and community.
The petitioner read a two page summary of their hardship. In the summary, the petitioner referenced
the proposed fence would be four (4') foot high to keep all lines of sight free from obstruction.
Chairman Childress opened the meeting to questions from the board.
Member Bookler inquired about what type of fence will be installed.
The petitioner stated they are going to replace a four (4') foot tall, chain link fence, with a four (4') foot
tall black, aluminum, open faced fence.
Members Serrano, Damptz Jr. and Glimco had no questions.

Dear Honorable Mayor and Board of Trustees:
On December 15, 2021, at 7:00 p.m., Zoning Board of Appeals Chairman, Donald Childress called
the hearing to order. The petition was read. Petitionertaila Bashia (Owner of Record), was sworn in and
asked to state her case for requesting a zoning variation.
Section 3-7: D (3) prohibits fences from being constructed within the required front yard and beyond a
line extended from the nearest front corner of the principal building located on an adjacent single-family
residential lot. The petitioner is requesting to install a four (4') foot high fence which will extend
approximately ten (10') feet beyond the nearest front corner of the principal structure on the adjacent
single-family residential lot to the Northeast at 1531 Montana Way. The fence will replace an existing
four (4') foot high chain link fence in the same location.
The following questions and comments were brought up by the Members:
1. The petitioner's hardship is that they are wanting to replace an existing chain link fence that
was removed to access the exterior of the house when it was remodeled. The petitioners
are seeking to provide privacy and safety while maintaining the aesthetics of the subdivision
and community.
2. The existing fence was a four (4') foot tall chain link fence.
3. The new fence is proposed to be a four (4') foot tall black, aluminum, open faced fence.
4. The new fence will be located in the same location as the existing fence.
S. No sight line issues are present with the fence in the current location.
6. Dan Vincent,1544 California Street, spoke in favor of the petitioners.
7. A neighbor, who did not identify themselves, came to the front counter of the Community
Development Department and stated they have no objection to the variation request.
8. Chairman Childress read a letter from Member Latrofa in support of the proposed variance.
Chairman Childress called for the motion.
A Motion to DO GRANT a variation to permit the installation of a four (4') foot high black, aluminum,
open faced fence which will extend approximately ten (10') feet beyond the nearest front corner of the
principal structure on the adjacent single-family residential lot to the Northeast at 1531 Montana Way.
This Motion was made by Member Damptz Jr. which was seconded by Member Glimco.
Vote to DO GRANT: Childress, Damptz Jr., Bookler, Serrano and Glimco
Vote to DO NOT GRANT: None
ABSENT — Romanski, Colgan, Latrofa, and Spragg
The motion carried.
Mr. Childress advised the petitioner to contact the Village Clerk and be available for the subsequent
Village Board Meeting that will hear the request. The meeting adjourned at 7:22 p.m.
