AN ORDINANCE GRANTING A VARIATION OF SECTION 3 -6:E -3B AND
SECTION 7-1 OF THE ZONING ORDINANCE PERTAINING TO THE USE
OF YARDS FOR PARKING VEHICLES TO ALLOW FOR THE PARKING OF
VEHICLES ALONG KENT AVENUE AND OAKTON STREET WHICH WILL
ENCROACH INTO THE 25 FOOT SETBACK ON PROPERTY LOCATED AT
859 OAKTON STREET, ELK GROVE VILLAGE (SMITH)
WHEREAS, the Zoning Board of Appeals, at a public hearing
duly called and held according to law, considered the question of
granting a variation of Section 3 -6:E -3B and Section 7-1 of the
Zoning Ordinance pertaining to parking of vehicles within the 25
foot required front yard for property located at 859 Oakton
Street, Elk Grove Village, and legally described hereinafter; and
WHEREAS, the President and Board of Trustees, after having
considered the recommendation and finding of said Zoning Board of
Appeals, find and believe that sufficient hardship exists so as
to justify the granting of said variation as requested;
NOW, THEREFORE BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook
and DuPage, Illinois as follows:
Section 1: That there be granted a variation of Section
3 -6:E -3B and Section 7-1 of the Zoning Ordinance to permit the
re -configuration of two (2) existing paved areas to allow for
parking of vehicles along Kent Avenue and Oakton Street which
will encroach into the 25 foot setback on property located at 859
Oakton Street, Elk Grove Village and legally described as
follows:
Lot 8 in Oakton Industrial Park Unit 2, Being a Subdivision
Of Part of that Part of the North Half of the North half of
the East Half of the Northwest Quarter of Section 27,
Township 41 North, Range 11 East of the Third Principal
Meridian, Lying Northwesterly of and Adjoining the
Northwesterly Line of Commonwealth Edison Company Right -of -
Way, According to the Plat Thereof Registered in the Office
of the Registrar of Titles of Cook County, Illinois, on
February 21, 1974 as Document Number 2740200, in Cook
County, Illinois
Section 2: That this Ordinance shall be in full force and
effect from and after its passage and approval according to law.
