Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting
of the Village President and Board of Trustees on February 11, 2020, this Executive Session was
called to consider review of Litigation.

Once the Village has completed the purchase of the former Phoenix Club, it may be possible to complete
the involuntary annexation currently under litigation. In light of the litigation regarding the Gullo
involuntary annexation, the consensus of the Board was to direct staff to look into which properties will
be eligible for involuntary annexation with this acquisition, and also to pursue an update to the Busse -
Elmhurst TIF study upon annexation of such properties.
