HIGGINSORDINANCE NO. 26 AN ORDINANCE REZONING PROPERTY LOCATED AT 1200 EAST HIGGINS ROAD, ELT{ GROVE VILLAGE, FROM B-2 GENERAL BUSINESS TO B-3 AUTOMOTIVE ORIENTED BUSINESS (FENDER MENDERS) WHEREAS, the Plan Commission, at a Public Meeting duly called and held according to law, considered the question of re -zoning certain property located at 1200 East Higgins Road, Elk Grove Village from the B-2 General Business District to the B-3 Automotive Oriented Business District for the purpose of operating an auto repair/paint shop; and WHEREAS, President and Board of Trustees of the Village, after having considered the recommendation and finding of said Plan Commission, find and believe it to be in the best interest of the Village to re -zone the property as requested, subject to certain requirements for the issuance of an occupancy permit as set forth in the findings of said Plan Commission; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DUPage, Illinois as follows: Section 1: That the property located at 1200 East Higgins Road Elk Grove Village, which property is legally described on Exhibit A attached hereto and incorporated herein, be and the same is hereby re -zoned from the B-2 General Business District to the B-3 Automotive Oriented Business District. Section 2: That prior to the issuance of an occupancy permit by the Department of Engineering and Community Development, the subject property must provide the following: a. The installation of a fence, with screening, as required by the Department of Engineering and Community Development. b. Installation of a paint/spray booth to eliminate fumes and odors in accordance with Village Code. c. The installation of sound insulation on the common wall of the building as deemed necessary in order to comply with the Village's performance standards. In addition, the Owner agrees to commit to the installation of a paved surface on the gravel area located at the north end of the property at such time that the building is expanded or the gravel area becomes used for parking of vehicles. Section 3: That the Village Clerk is hereby directed to amend the zoning map of the Village to incorporate the re -zoning as set forth in this Ordinance. Section 9: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 10th day of February 1998.
