HomeMy WebLinkAboutORDINANCE - 2640 - 5/12/1998 - SITE PLAN, AMENDEDORDINANCE NO. 2640 AN ORDINANCE AMENDING ORDINANCE NO. 2557 PERTAINING TO THE MOBIL OIL PROPERTY LOCATED AT THE NORTHWEST CORNER OF MEACHAM ROAD AND NERGE ROAD BY APPROVING AN AMENDED SITE PLAN AND PROVIDING CONDITIONS FOR THE CONSTRUCTION AND CONTINUAL MAINTENANCE F OF THF. g T .DTN. AND PROPERTY, WHEREAS, on May 23, 1978 the Village President and Board of Trustees, pursuant to Ordinance No. 1223, rezoned certain property located at the Northwest corner of Meacham Road and Nerge Road to the B-3 Automotive Orientated Business District to permit the construction of a Mobil Oil service station subject to compliance with an approved Site Plan; and WHEREAS, Mobil Oil submitted an amended Site Plan for the property which amended Site Plan was approved by the Village pursuant to Ordinance No. 2557, duly passed and approved on April 22, 1997; and WHEREAS, Mobil Oil is desirous of changing the amended Site Plan and proceeding with remodeling the current structure, and in that regard has submitted a second amended Site Plan for review by the Village; and WHEREAS, the President and the Board of Trustees of the Village of Elk Grove have considered approving the second amended Site Plan, as revised, conditioned upon Mobil Oil adhering to certain conditions with respect to said property, which conditions are hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That that portion of Ordinance No. 2557 pertaining to the adoption of an amended Site Plan dated April 12, 1997 is hereby amended by substituting therefor a second amended Site Plan and Landscape Plan dated April 14, 1996 which Plans are hereby formally approved and that all remodeling and other improvements to the subject property shall be done in accordance with the second amended Site Plan and Landscape Plan, three copies of which are on file in the office of the Village Clerk. Section 2: That this Ordinance is subject to the adherence by Mobil to the following conditions: 1. Mobil will remove the existing fence on their West property line and replace it with a board -on -board type fence at the top of the planned berm. The remaining area between Mobil's property line and the new fence will be covered with an approved maintenance free ground cover and be maintained by Mobil at their expense. 2. Mature landscaping shall be used for all new plantings on the subject site including ten (101) foot pines and evergreens to provide adequate screening on the site. Mobil shall use its best efforts to retain the maximum amount of existing landscaping, and remove trees on an "exception" only basis. Only those trees which will impede the installation of the planned facilities will be removed. Compliance with this will be insured through a site inspection by the Director of Engineering and Community Development prior to the removal of any trees. 3. Mobil will extend their fence onto the residential lots abutting Meacham and Nerge Roads to provide for an acceptable connection to the existing residential fence structures. Both extensions will have gates for resident's use. All other existing fences will be extended to Mobil's new fence by the individual property owner over easements provided by Mobil. E 4. The building will be three thousand (3,000) square feet and shall be constructed with an all brick exterior. 5. Mobil will provide a performance bond to the Village in the amount of $1,000.00 to be drawn upon for repairs to the fence and property if they are not completed by Mobil within two weeks from the time of any complaint initiated by the Village. 6. Hours of operation for the convenience store will be from 5:30 a.m. to 10:30 p.m. Section 3: That there be granted a variation of the Municipal Code pertaining to the minimum width of boundary landscaped area to permit a width of five (51) feet as occasioned by the relocation of a canopy. Section 4: That this ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 5 NAYS: 0 ABSENT: 1 PASSED this 12th day of May , 1998.
